EJ - is looking at a submission we haven't seen - a liability concession by Cambridge County Council.

EJ is asking questions about earnings and the figures. NC - recommendations - important concession was made in tribunal in public. We will be claiming costs. EJ - how long will it take? NC - suggest reports back at noon.

Reporter's note: This means the respondents have admitted discrimination so there will be no evidence from either party. The barristers will now prepare recommendations to be considered by the Judge at noon.

It sounds like the respondents won’t defend Lizzy’s claim. Is the message finally getting through that it’s not ok to discriminate against people in this way?

(The cynic in me thinks that organisations don’t want the reputational damage that the OU, ERCC and SWE have had. So they let the claims get to the point of being funded and then bail. The process is still the punishment - and those who are unable to crowdfund for whatever reason have limited access to the tribunal process and/or are reliant on self representation, which is nowhere near as risky for the respondent in terms of damage to reputation. And so will the discrimination continue, with organisations opting to face the risk that someone might successfully fund a tribunal hearing - at which point they just settle - but banking on the fact that most won’t/cant? I suppose the only way to prevent that is if the damages awarded at settlement are enough of a deterrent in themselves, and NC seems to be on the case with that!)

I too was looking forward to batshittery and, possibly, a support menagerie. Remembering though how upsetting this process has been for some of our heroines, I can't really be sorry they won't have to go through the ordeal of giving evidence.

If organisations/institutions are realising it’s against the law and claimants are likely to win, if they don’t prevent the discrimination they’ll still end up paying out, suffering reputational damage and losing staff who are expensive to replace. Most people don’t align with full-throttle genderism views such as that twaw in all situations and that women should never have single sex provision. So that’s most people at risk of being discriminated against for perfectly reasonable beliefs.

Surely it would be in most organisations’ interests to question what’s gone wrong with the misrepresentation of the law to their HR and DEI departments and root out the problem and make it clear to all staff what they are allowed to think.

The discrimination will continue. They'll just not be so overt about it.

Another one here who was looking forward to a day of batshittery. One of my greatest pleasures in the past few years has been observing the massively ludicrous behaviour of these people once they get inside a courtroom. (No, I don't get out much.)

But this follows close on the heels of the Liberals admitting they were wrong in the Natalie Bird case, so I do think that maybe finally the message is reaching home. After the Rachel Meade case and countless others it's become quite clear that discriminating against staff because they believe in the reality of biological sex is against the law.
