I hope they ask the respondents witnesses about the downgrading from gross misconduct as an admin error - that will need some verbal gymnastics to explain.

He doesn't sound like he has a good handle on the bundle, bundle, bundle.

I understand there will be a lot of information in it - but thats a basic bit of information? As was yesterday when she corrected him, her previous job was Glasgow, not the Borders.

RA seems to be very calm and considered, she's a great witness. (I'd be sighing and muttering and eye rolling like a stroppy teenager)

Not sure about legal requirement. But there should definitely be a legal requirement to be clear if they are single sex or mixed sex. And if mixed sex (because TWAW) then other men should be allowed to join too. So it is made clear ERCC is a mixed sex service. And organisation which allow people to chose ‘the facilities that match their gender’ should be obliged to label them ‘mixed sex - feminine’ and ‘mixed sex - masculine’ or even ‘people wearing skirts and dresses’ and ‘people wearing trousers’. And if that results in discrimination against women then they must provide a single sex service for them too.

So race is sensitive data. Imagine a service user sent an email saying 'i'm black, and I would like to know if my counsellor is black too." Does this mean it would be a breach of the GDPR to discuss the counsellor's race?

That's not what I asked. If I were to email a specific support person at ERCC, and say I need to know if support will be female only and specifically ask that there are no biological males, and they discuss my email among themselves and put it in a folder marked "TERF shit", maybe send an all staff email about it, is that also a breach of my personal sensitive data? I didn't give them consent to process it in that way. DPA isn't just for employers.

If it was the NHS in Brighton and you'd requested a female mammographer, you'd get actual staff letters circulated about you calling you transphobic, even if you'd got an actual MBE for services to LGBT.

But that's all fine, isn't it, TRAs.

For my tribunal (not employment one) I had everything in my bundle tabbed and colour coded. Knew where everything was, knew more or less what sort of stuff I was going to get asked. It started and I was like a deer caught in headlights, I could hardly take in a word that was being said and the first time I got asked a question I just went completely blank and they ended up letting my barrister answer it for me! So these women who are going through these long drawn out tribunals I am in awe of their strength and ability to hold it together!!

I think that's unfair. If you've ever given evidence in proceedings like this you'll know that you have to have breaks. It's utterly gruelling and you need recharge time. In my experience anything beyond an hour and you start to lose focus, and, significantly for the court, are more ready to give the other side the answers they're after just to make it stop.

@Boiledbeetle I'm sure I'd be the same. Just watching these (I was able to catch some of the Jo Phoenix one and the Allison Bailey one) gives me a stomach ache. I'm not sure I'll even carry on watching after lunch. So god only knows how I'd cope if I were actually involved. I am so, so impressed by RA.

I followed those cases on MN thanks to the Glorious Women of Mumsnet as well.

@HarpQuartet one thing my former barrister and solicitor colleagues all were agreed on was that we'd make exceptionally crap witnesses in a court room. RA sounds a force. Good on her.

real story i was chair of a RCC prior to GRA and all that stuff. Manager of centre and head counsellor told me that a colleague working in another centre was living with a split personality and sometimes went to work as a man. Her/his area of specialism was working with people who lots of personalities, spat my tea out and said how does the client and counsellor know who is meeting who

I was surprised at what poor witnesses so many of Allison Bailey's Chamber colleagues were. Even more so that they appeared to be unaware of how poorly they came across. I think some were aiming for passionate or thoughtful but came across as irritated/disdainful or equivocating (respectively).

I think a lot of the time this stuff is only an issue when people complain. It's hard to guarantee that you will never be in breach of such a wide ranging category of information.
