This is the case where Mermaids challenged the Charity Commission's decision to give charitable status to the LGBA.

Don't have any more detail at the moment, but thought you'd all be interested. It's been a four month wait already.

What a horrible website. Searched for mermaids and nothing recent so assume it's not out yet.

spannasaurus · 21/04/2023 10:28

There's also a separate website for the charity tribunal decisions. No decision listed there yet.

It does take a bit of getting used to, i agree.

But, someone will post it here as soon as it's available, i'll be bound.

Come on!!

I think this thread was started to wind us up. But it has taken ages.

I remember hearing a talk by a retired judge who used to make his judgements within a couple of days of a case as he preferred to do it when the arguments/evidence was fresh in his mind. His fellow judges complain and said it made it look like his judgements were hasty and illconsidered and put pressure on them. So he still wrote his judgements in a few days but would then leave them in a drawer for a couple of months.

AutumnCrow · 27/04/2023 09:36

The tribunal ran from 9th-15th September 2022, didn't it?

That's over 7 months ago!

guinnessguzzler · 27/04/2023 12:12

Ha ha that's classic @Shelefttheweb Humans are complete fuckwits, aren't we?! 😂😩

maltravers · 27/04/2023 12:14

Justice delayed is justice denied. This delay is hurting Lgba’s fundraising ability.

Wasn’t there an extra bit in November as well or am I getting my tribunals in a muddle?

Good grief!

SidewaysOtter · 27/04/2023 20:23

I’m sure they said at the time that it could be 9-12 months?

IcakethereforeIam · 27/04/2023 20:26

I'm clearly very ignorant of the law. I don't understand why it's taking so long.

PizzaNinja · 27/04/2023 20:59

<sigh> Still waiting 🙄

The ‘waiting’ gif selection is excellent.

Still waiting gif is good

But why? What is it about this case that needs such a long time?

GrabbyGabby · 28/04/2023 09:30

The wait is really damaging. The LGBA cant clear their name and get on with their mission, and Mermaids in the meantime have decided they aren't woke enough, and are heading even deeper into the abyss, no doubt damaging more children as they go.

This judgement should have been made as quickly as possible.

I agree with this. Sometimes the law itself and particular how long the delays are seems to cause almost as much harm as whatever is being litigated.

Lesbians are being harmed, children are being harmed, where's the duty of care?

ResisterRex · 28/04/2023 09:41

I agree about the length of time. It also damages public confidence in the judicial process.

MargotBamborough · 28/04/2023 09:45

I wonder whether the tribunal judge is pro Mermaids and can't find a way of ruling in favour of Mermaids so is delaying for as long as possible instead.

I'm a lawyer and I've just said that, so clearly the wait is undermining confidence in the legal system.

I wondered that too. As you say, it undermines confidence.

Given the oh so secret "training" that's been given to the judiciary which is apparently so dodgy that the details must be kept secret from the public, that's a legitimate concern.

EmotionalSupportHyena · 28/04/2023 09:49

I would wonder if the charity commission investigation into Mermaids is part of the hold up but surely the ruling can only be based on what was heard in person and submitted in evidence at the time?

Yes, my understanding is that although the investigation could have been referred to in the closing statements to provide additional context about the fact that there are serious concerns about some of Mermaids' activities, the accusations against the LGB Alliance which are the subject of the litigation predate the investigation, so the investigation shouldn't in theory influence the outcome of the decision.
