This is the case where Mermaids challenged the Charity Commission's decision to give charitable status to the LGBA.

Don't have any more detail at the moment, but thought you'd all be interested. It's been a four month wait already.

I know the case went on for ?two weeks, so lots of evidence heard which needs to be properly reviewed and discussed in the eventual judgment.
But (maybe I'm being a bit simplistic here) I feel as if it's a fairly straightforward judgement to make and shouldn't tax the judge's brain for too long.
Does a charity have a right to challenge another charity's charitable status?
Can a charity set up for horse welfare reasonably complain about the existence of a charity set up for donkeys, which might draw attention (and funds) away from the more important horses?

EmotionalSupportHyena · 28/04/2023 14:31

I love donkeys.

(and goats).

I have loads of donkey photos saved on my phone.

sorry/not sorry for this post.

I feel guilty for having started this thread and got everyone's expectations up, but I thought my source was reliable! Last week, the fox-killer also mentioned on Twitter that the judgement was due soon. So where is it?

One can never be sure a judgment is about to be published until the point at which the draft judgment is circulated to the parties for a fact check. Jolyon should know that.

When jolyan said it was expected v soon I thought it might be because it was being circulated to the parties. Presumably not after all. Wasn't good law project involved in the case?

I thought about a week ago JM and the LGB Alliance both said the result was imminent

LOL. 😂

I want to know the outcome of this case. I hope the wait isn’t much longer.

I think we’re all forgetting that in legal circles, “soon” can mean “any time in the next six months” <glares at conveyancers>

On delay, by the Chancellor of the High Court 2020 (in this case the judgement was delayed by 22 months):

”I should conclude on this point by reiterating that the "3-month" general rule should be adhered to even in long and complex cases. Justice delayed is justice denied. The parties to civil, and particularly commercial, litigation are entitled to receive their judgments within a reasonably short period of time. That period should not be longer than 3 months. As has been repeatedly said, any other approach will lead to a loss of public and business confidence in our justice system.”

“Justice delayed is justice denied” - judgments should be delivered within 3 months - Wiggin LLP

In a judgment handed down by the Court of Appeal earlier this month, Sir Geoffrey Vos, Chancellor of the High Court, described a High Court judge’s delay in giving judgment for 22 months as “inexcusable”. The Chancellor held that parties are entitled t...

That appears to have been ignored left, right and centre!

That is what I thought. Does nobody hold judges to account for things like this? Waiting up to nearly two years for a judgement in some cases is outrageous.

Ameanstreakamilewide · 09/05/2023 10:07

I know legal wheels turn slowly, but man alive - 2 years is scandalous.

How can it possibly be justified??

I'm trying to think of another industry where this delay would just be blithely accepted.

FFS!

if anyone wants to kill some time, the Blocked and Reported podcast on Jolly-on is pretty amusing (Katie Herzog’s attempt at saying his name is WELL funny).

Gasp0deTheW0nderD0g · 15/05/2023 14:33

Thanks for that recommendation. Enjoyed that very much.

What is the pronunciation of Jolyon?
I had always assumed "Jolly on", is that wrong?
"Maugham" is a bit of a mystery to me too :D

I think it's called the Fox and the Clown. The first part is about the man who died on the subway after an ex-Marine put him in a chokehold. That was interesting too. Far more complicated than I'd understood from the brief reports I'd seen (surprise, surprise).

I thought it was pronounced Bore On . . .

No phonetically it is pronounced:

Jol = Fox
y = kil
on = ler

Though in some accents the name can be pronounced “repeated court loser”
