Spousal Exit Clause: Great news for trans widows

Great news for trans widows, and a vindication of the arguments made by Trans Widows Voices, against the lies and misrepresentations told about the "spousal veto"

Excerpt from the governments response to the Women and Equalities Commission report on reform of the GRA:

  1. A marriage or civil partnership is a contract between two individuals, the nature of which cannot be changed without the consent of both parties. For this reason, we considerit is equitable for the "spousal consent" requirement to remain in place.
  2. Spousal consent does not mean that a spouse can prevent their partner from securing a GRC. It is a safeguard for the non-transitioning spouse to decide whether they want their marriage or civil partnership to continue before their partner is granted a GRC. It is right that both parties should have an equal say in the future of their marriage or civilpartnership, given transition can fundamentally change its nature.
  3. More widely, we anticipate that the Divorce, Dissolution and Separation Act 2020, which comes into force later this year, will help to reduce conflict in such circumstances

Congratulations, tinsel and all of the other transwidows who shared their stories, lobbied and made this happen 🥳

I had a LibDem who wanted my vote stand on the doorstep and berate me about the injustice of the “spousal veto” when we were talking about sex based rights and gender identity. Unfortunately, at the time, I didn’t understand enough about it to argue back, and I lost that point. But after reading more about it here, I reckon I could take her down on it now Grin

Bizarre that she felt lecturing me about my “bigotry” l would gain her my vote, but the Lib Dems really seem to be working all out not to get elected, so…

🍾🥂Flowers congratulations Tinsel (or should I say Des?) great news for those potential trans-widows.

AssignedBlobbyAtBirth · 24/03/2022 18:47

It's more like annulment because the terms of the marriage have changed. It is very important and means that women who would not want to divorce for religious reasons can exit the marriage

NitroNine · 24/03/2022 19:01

Oh what fantastic news! You deserve to enjoy this win - & to celebrate it.

Whitefire · 24/03/2022 19:04

Fantastic news. Well Done.

mathanxiety · 24/03/2022 19:10

...and because it allows the spouse to exit the marriage BEFORE the GRC is issued.

With no fault divorce, a spouse can leave a marriage any time, for any reason or none.

I understand the problems facing people who may feel they can't divorce for religious reasons, since the hope is that that a form of annulment will be introduced.

My concern would be that this will constitute such an affront to the trans worldview that there will be major pushback, and all that will be left is no fault divorce, which has appeal for the general population.

DomesticatedZombie · 24/03/2022 19:11

Bizarre that she felt lecturing me about my “bigotry” l would gain her my vote, but the Lib Dems really seem to be working all out not to get elected, so…

It's a theme.

TinselAngel · 24/03/2022 19:24

My concern would be that this will constitute such an affront to the trans worldview that there will be major pushback,

What, keeping the law the same as it is now? You're suggesting we should keep quiet so we don't antagonise them, and presumably just let them take our rights away? Fuck that I've been there before

They couldn't push any harder on this than they have been doing. They've had the support of everyone from Stonewall to the unions to bloody NatWest Bank. They had a bill introduced in the House of Lords FFS.

OP posts:
TinselAngel · 24/03/2022 19:27

since the hope is that that a form of annulment will be introduced.

I should have just quoted the whole post. THIS IS WHAT THE LAW IS NOW. We don't have to hope for this. What you describe is what the current law is and what has been announced today is that it is STAYING THE SAME.

Jesus.

TinselAngel · 24/03/2022 19:27

I thought I might get the day off from explaining the law to people who breezily misrepresent it, but apparently not!
