Spousal Exit Clause: Great news for trans widows

Great news for trans widows, and a vindication of the arguments made by Trans Widows Voices, against the lies and misrepresentations told about the "spousal veto"

Excerpt from the governments response to the Women and Equalities Commission report on reform of the GRA:

  1. A marriage or civil partnership is a contract between two individuals, the nature of which cannot be changed without the consent of both parties. For this reason, we considerit is equitable for the "spousal consent" requirement to remain in place.
  2. Spousal consent does not mean that a spouse can prevent their partner from securing a GRC. It is a safeguard for the non-transitioning spouse to decide whether they want their marriage or civil partnership to continue before their partner is granted a GRC. It is right that both parties should have an equal say in the future of their marriage or civilpartnership, given transition can fundamentally change its nature.
  3. More widely, we anticipate that the Divorce, Dissolution and Separation Act 2020, which comes into force later this year, will help to reduce conflict in such circumstances

Congratulations to Tinsel and all of you other brave women who had to share your traumatic history in order to have your needs listened to at crucial times.

TinselAngel · 24/03/2022 14:54

@Aroundtheworldin80moves

I've never understood why they want to force someone to remain married to them. Unless its control.
Part of it is control and general make entitlement and part of it is because the spousal exit clause stands in the way of self ID.

Well done Tinsel. Nokes needs to stop talking about it and start listening to real women.

CompleteGinasaur · 24/03/2022 14:54

So bloody important, and so brilliantly done, Tinsel et al. Magnificent work. As PP said, have no skin in this game, but reading your heartbreaking threads and being possessed of a tiny bit of empathy.. How you all managed to go through all that and put up with the slurring mischaracterisations of what this actually is about? If that's the worst of you venting you're infinitely more gracious than I could ever manage.

Star Star Star

NonnyMouse1337 · 24/03/2022 14:56

So pleased that the spousal exit clause has been retained. All thanks to your hard work, Tinsel, in making the case for trans widows.

Male entitlement!

@TinselAngel

Male entitlement!
That was a correction of the typo in my previous post not a general exclamation!

The government are planning it, I don't know if that means that it will definitely happen.

It's all a bit unnecessary given no fault divorce is about to come in. Anyone married will be able to bring their marriage to an end by ticking a box on a form. It's grandstanding to make this an issue .

ChopinBoard · 24/03/2022 15:33

Hurrah! Good news for once.

Don't want to derail by focusing on Nokes' nonsense but I do wish she would stay on that train of thought all the way to the station where it terminates:

"I am disappointed that the Government is unwilling to take simple steps- such as the removal of the requirement to live as a stereotype in an acquired gender, or the requirement for a 'gender dysphoria' diagnosis ..."

Caroline, what else is there?

Ereshkigalangcleg · 24/03/2022 15:35

Nokes not very happy

That's a shame.

Not really. The need for it will remain even after the no fault divorce come in as a spouse could still choose to transition whilst still married, before any divorce is started, let alone finalised. All the legal as well as emotional objections will remain.

Grandstanding would be going back to the original transitioning male objection to being made to wait whilst his unhappy wife gets their legal issues sorted and her emotions acknowledged - all because he won't wait for a few months and chooses to call that a veto!

Oh for goodness sake, we need the spousal exit clause because it makes provision for annulment which is necessary for people who can't divorce, and because it allows the spouse to exit the marriage BEFORE the GRC is issued.
