Great news - I wonder if FPFW can use this in their census appeal?

Signalbox · 18/02/2022 10:39

Amazing

DomesticatedZombie · 18/02/2022 10:51

Truly amazing. Looking forward to hearing legal people explain what this means - I'm hoping it's setting a precedent for upholding the EA single sex exemption.

Excellent news but it's kind of ridiculous that two legal cases have resulted in two diametrically opposing judgements.
OvaHere · 18/02/2022 11:11

Excellent. This is a bit of a surprise but a glimmer of hope in Scotland.

Artichokeleaves · 18/02/2022 11:18

Great news. I'm still baffled as to how the legal definition (and therefore the protections in law) of half the population of the UK has never yet made it into a manifesto, or the population given any kind of say in it. This is so massively significant (and dangerous) for women that it ought to go to a bloody referendum.

You'd also think that it would be realised that something that has to be achieved by back room deals, on the quiet, through lying about what laws actually say, and as discreetly as possible to avoid the general public realising until it's too late, is dodgier than all hell and shouldn't be happening.

It has become crucial that women get established in law that adult human female has a meaning, is a distinct group, and their biological reality and challenges of access are not muddled and concealed behind agendas driven by a male-centric political lobby, representing less than 1% of the UK male population, with no interest whatsoever in the wellbeing or equality of the female half of the human race, or anything beyond their own interests.

This has really cheered me up this morning! I was so depressed yesterday about the absolute mess that women's rights in Scotland seem to be in after the census decision, but there is now perhaps at least a chink of light.

This!

It's getting almost routine. Nonsense first judgments then winning on appeal.

I think the Keira Bell case was one of the few doing the reverse. (Which just means a third round to get it right...)

Imnobody4 · 18/02/2022 11:47

Great news, just what I needed to lift me up after that census ruling.

I'm floored.
Literally on the floor with admiration for these women.

ItsAllGoingToBeFine · 18/02/2022 11:57

Just saw that Lady Dorrian was the judge in this case, I wonder if the judges sex makes a difference to how they approach these?

Waitwhat23 · 18/02/2022 12:02

FWS are absolutely brilliant

The the 2018 Act did not redefine “woman” for any other purpose than “to include transgender women as another category” of people who would benefit from the positive measure. Therein lies the rub: “transgender women” is not a category for these purposes protected characteristic and for the reasons given, the definition of “wom ; a it is no t a n” adopted in the Act impinges on the nature of protected characteristics which is a reserved matter. Changing the definitions of protected characteristic, even for the purpose GRO , is not permitted and in this respect the 2018 Act is of achieving the outwith legislative competence.

Humbold · 18/02/2022 12:22

Well done FWS - great news.

HandsOffMyRights · 18/02/2022 12:33

Fantastic news. Huge thanks and congratulations to everybody who was involved.

FWS are again the best investment I have ever made for my daughters' future. Flowers

Can I hope that this "the definition of “woman” adopted in the Act impinges on the nature of protected characteristics which is a reserved matter." means any change to self ID is also a reserved matter?

Mollyollydolly · 18/02/2022 12:34

FWS are amazing aren't they. I admire them so much. They just keep on and on. Amazing group of women.
