Surely the judgement has to be in Maya's favour? The EHRC intervened to say that her belief (in reality!) should be protected under the law.

If the judge goes against that then wouldn't that be a very odd position to be in, where the Court of Appeal was disagreeing with the EHRC on a point of law?

There have definitely been cases where the courts have disagreed with the EHRC's position (I can think of one off the top of my head), but I don't think there will ge any disagreement here. I could be wrong though - I was gobsmacked by the original judgment.

It's in the Employment Appeal Tribunal at the moment by the way rather than the Court of Appeal - the Court of Appeal would hear any further appeal.

Getting confused with Keira's trial, which is (I think?!) at the Court of Appeal - and that's coming up soon too. So many trials!

I was gobsmacked by the original judgment

I wasn't completely surprised - although I was gutted. I was at the trial and on the second day the judge was tripping over himself to use "correct" woke language. Doubt started to creep in at that point. I think he must have had the training.

This is a higher court, though, so surely less likely to be influenced by woke indoctrination?

And, the reasoning was bogus the first time - the judge made his judgement on evidence that didn't exist - he claimed for example that Maya would misgender people to their faces at work because of her "absolutist views" - when she said she would use preferred pronouns at work.

Surely that trick won't work twice?

I believe in freedom of speech and all that, but i have to be honest and say i dont think she should win this. GC beliefs aside i think it was the way she went about them that made her get fired (or loose her contract or whatever it was)

This hearing was just about whether her belief in biological sex should be protected though, wasn't it? If she wins this, then there would be a further hearing about whether she was unfairly dismissed.

I'm not enough of a legal mind to understand the approach even having read the documents, but it always did feel strange in this case to have something so basic put forward as a belief - I thought originally the case would fail because it would be hard to say that a demonstrable fact was a belief. Obviously that wasn't the reason for the loss, and the first judgment seemed largely unrelated to the evidence to me. As I said, not a legal mind.

But it's not (at this stage) about looking at how she manifested those beliefs - it's about whether the beliefs are in capable of being protected. It would be absolutely bonkers when there is plenty of case law saying that eg belief that homosexuality is a sin is protected, for Maya's beliefs not to be.

It may be that she wins this, but ultimately loses after a further hearing on the manifestation issue (although I personally hope not), but she ought to win this. The Tribunal judgment was genuinely bizarre. It really is supposed to only be the most extreme beliefs (eg Nazi and white supremacy beliefs) that are not covered by the Act.
