Wishing her the very best of luck. twitter.com/MForstater/status/1402310977115279362?s=20

I'll be absolutely gutted if the original decision isn't overturned, but at least her case has let a lot of sunlight in.

@SelfPortraitWithEels

[Flowers] Flowers Flowers for Maya!

I don't get that bit of the judgement, though - what other protected characteristics might be relevant if someone doesn't qualify for gender reassignment?

Belief

So in the same way we can't follow a muslim round criticising their faith or putting pork sandwiches on their desk in ramadan but we can still have lunch in ramadan, so we cannot follow a transgender individual around saying their belief is wrong NOR can they do the same to those who believe sex is fixed.

eurochick · 10/06/2021 11:01

Woo hoo! Having to celebrate the courts acknowledging that a belief that sex is real is not a view unworthy of respect is bonkers, but here we are.

Maya, I advise people litigating cases for a living and I know how stressful it is for those involved. Thank you for putting yourself through this.

CardinalLolzy · 10/06/2021 11:02

Just out of interest, does anything happen re the original judge if the appeal finds that the law was applied incorrectly? I'm not saying it should, just wondered if it meant anything that a case you judge on then goes on to be overturned for these reasons.

ShirleyPhallus · 10/06/2021 11:02

Amazing news. What an emotional moment

WinterTrees · 10/06/2021 11:02

A bonkers sour grapes statement from Maya's former employers just read out on WH. 'The ruling is disappointing.' 'A step back for inclusivity.'

When are people going to start waking up to the fact that 'inclusivity' isn't some utopian gold standard? That there are plenty of instances in everyday life where excluding certain groups and keeping demographics separate is not only perfectly acceptable but promotes equity and fairness?

ThrowAwayName01 · 10/06/2021 11:02

Yay for common sense! Maya has been through so much, and this case is so important. What a relief!

Wrongsideofhistorymyarse · 10/06/2021 11:03

Sex. If a TW failed at gaining a promotion for wearing a dress to the interview (for example) that could easily be argued as sex-based discrimination because a woman would be allowed to wear a dress with impunity.

Absolutely. I can get behind this kind of protection for gender variant people.

Northernlurker · 10/06/2021 11:03

Fabulous news

NotTerfNorCis · 10/06/2021 11:04

Great news! Congrats Maya.

IShouldBeSoLurky · 10/06/2021 11:04

Of course I know what Stormfront is, and deplore it. Just the frothy rage of the misogynist, and that thrush was the worst he could wish on us, made me laugh.

MrsBunHat · 10/06/2021 11:04

Sad to hear that Lisa feels she can’t go to her graduation

Yes but it is her choice to make and I can completely see why she wouldn't want to play nice with the institution that did that to her, or even go near it. There is also a potential risk to her now it's quite high-profile.

CroydianSlip · 10/06/2021 11:04

'Be Braver today than you were yesterday'

Emosh!

BewitchedBotheredandBewildered · 10/06/2021 11:04

Fantastic news!

Abhannmor · 10/06/2021 11:04

@IShouldBeSoLurky

Just saw someone on Twitter refer to MN as “Prosecco Stormfront” which to be fair is pretty funny.
The cheek of them! Prosecco Pravda please.
Datun · 10/06/2021 11:04

It's so odd that most of the country today doesn't even realise that a woman has had to go to court to establish the fact that believing biological sex is real had to be legally established.

risefromyourgrave · 10/06/2021 11:04

SelfPortraitWithEels · 10/06/2021 11:04

Yes, the censorship of language can stop. Now.
Soontobe60 · 10/06/2021 11:07

Quote from the judgement - we should all take not of this!

it is not for the Court to inquire into the validity of a belief, the Tribunal did just that, including by taking the view that the Claimant’s beliefs were not supported by scientific evidence. What it ought to have done, submits Mr Cooper, is to consider whether the Claimant’s belief was of the kind that would make Article 17, ECHR relevant. Had the Tribunal taken that approach, it could only have concluded that the belief was worthy of respect in a democratic society. Not only is it worthy of respect, but it is also one that is consistent with the common law under which sex is regarded as binary and fixed at birth for the purposes of all legal provisions which make a distinction between men and women

MrsBunHat · 10/06/2021 11:07

Absolutely - and also that when "inclusivity" is only for the most trendy, virtue-conferring groups, and not for women as a sex or anyone who has a different view, it's not really inclusivity is it?

catgirl1976 · 10/06/2021 11:07
