Scottish woman told would be charged for homophobic and transphobic tweets

On Wednesday April the 28th 2021 I received a call from a PC Laura Daley from police scotland requesting i attend an interview for homophobic and transphobic tweets under the milacious communications act.

I was asked to attend that coming Friday, she told me I had to attend East Kilbride police station so I could be then transported to Cathcart police station in a police car because I would have to go to a police station where there is holding cells, I would be then processed, questioned and then most likely charged.

I told her I would not be attending any interview on that day especially with it being a bank holiday weekend because my autistic twins needed me and I was scared I would be held all weekend.

To this she told me she would attend my house with social workers for my boys.

I contacted a solicitor straight away and he was unable to get PC Daley so for the first bank holiday in May I sent my disabled twins away for fear of this officer carrying out this threat.

This absolute nonsense has been hanging over my head for a month, I can barely sleep
or eat and I still don't know what the offending tweet is, my new interview has been scheduled for Thursday the 27th May, I will find out what I am supposed to have said at that point and if I will be indeed charged, again at another bank holiday, I just want to say, anyone who knows me, knows I am not homophobic or transphobic, I am a hard working mummy who would fight to the end for the safety and dignity of women and girls and for my vulnerable twinnies.

If we sit back and do nothing we will regret it for ever. For this reason I will never
Wheesht.

It cannot just be about those two tweets. Scotland cannot be a country where you can be arrested and threatened with social services for your children for tweets of that nature.

It is a country where the police announced they have a flying squad ready to remove any stickers that say "womenwon'twheesht"

Why would the Hate Crime Bill law not be used yet? Has it passed all the stages?
It requires ministers to write regulations to introduce it. Last I checked this hadn't happened. The act itself is law (the need for regulations is part of the act)

Or perhaps downloaded some child abuse videos - I know the cops have openly said they don't have time to prosecute all those cases.

I have never meant this more sincerely in my life, even when I used to listen to Rage Against the Machine: fuck the police.

It’s certainly a very effective tool to turn a high number of people against your organisation. I live next foot to a police officer. NEVER AGAIN if I get the choice.

I was wondering why they had targeted Marian specifically, when apparently the worst tweets they can find from her are "Get over your vagina envy" and "Should have gone to Specsavers", which by twitter standards are pretty mild.

I've since found out that the reason they doxed her months ago is because TRAs (wrongly) thought she was one of the founders of For Women Scotland.

This is entirely strategic, and has nothing to do with people being offended and feeling unsafe.

Why on earth is a holding cell required anyway? Is this normal practice? She isn't violent or likely to be a flight risk, so why would this be necessary.

This needs to be in the newspapers and heard about as widely as possible.

If not, I'm sure there soon will be, the way things are going in Scotland. Lots of them.

Threatened with holding cells.
Threatened with removal of her children.
Threatened with being detained over holiday weekend.
Not being told the detail of her purported offence.
Told she will be being charged.

Is this really normal police procedure for a (most likely) non criminal tweet?

This wouldn’t happen if she had made racist tweets or ableist, ageist... this isn’t even happening to men on the internet threatening women with death or rape.

Had a look through Marion's twitter feed going back quite far, the tone is harsh, lots of comments about protecting her autistic boys and the safeguarding implications of predatory men and self id, she talks a bit about links with the movement and fetishism. I can see how it would look like she thought all trans people were predatory fetishists, but she does make a distinction between these groups and genuine trans people on several occasions.

She doesn't mince her words and her tweets taken in isolation do come across as a generalisations, but no hate that I can see.

To be frank though even if there were, this is the problem with the concept of hate speech. They are just words and only words expressing one side of this debate are targeted, and only this debate is targeted.
