The court ruling over Keira Bell and whether or not she could have properly given consent to puberty blockers looks like it could open the door to compensation and claims against the NHS for allowing children to undergo this ideological and dangerous experiment.

Is it also too much to ask for the leadership of the Tavistock to resign after this? They have been giving harmful and unevidenced treatment to children who had no capacity to consent.

@yourhairiswinterfire

Keira has been awarded 80% costs, according to ObjectUK.
That's fantastic!

The judgement reveals a lot about what goes on when a child is referred to one of these services. The lack of data collection is shocking, as is the extent of the affirmation approach:

The court asked for statistical material on the number, if any, of young people who had been assessed to be suitable for PBs but who were not prescribed them because the young person was considered not to be Gillick competent to make the decision, whether at GIDS or the Trusts. Ms Morris could not produce any statistics on whether this situation had ever arisen. She suggested that in the main, GIDS would work with the young person to give them further information, discuss the matter further and in some cases wait until they had achieved further maturity. The court gained the strong impression from the evidence and from those submissions that it was extremely unusual for either GIDS or the Trusts to refuse to give PBs on the ground that the young person was not competent to give consent. The approach adopted appears to be to continue giving the child more information and to have more discussions until s/he is considered Gillick competent or is discharged.

So glad to have some good news! Keira is so brave, absolute shero!!

MammothMashup · 01/12/2020 11:52

Is Jo suggesting you can buy PBS on the dark web? Shock

Melroses · 01/12/2020 11:53

I hope they take that CBBC series off now. Along with that awful interminable series they did on the Womans Hour serial.

They should not be 'educating' any child or their parents/grandparents into believing that 'changing sex' is an achievable and normal route for a child to take.

It is irresponsible and they need to rethink.

He he is suggesting that is what desperate transchildren will be forced to do because of the nasty feminists.
LittleCabbage · 01/12/2020 11:54

Congratulations Keira!!!!!!!!

ItsAllGoingToBeFine · 01/12/2020 11:54

@picklemewalnuts

This for me is the pin point. iv) the fact that cross-sex hormones may well lead to a loss of fertility; (v) the impact of cross-sex hormones on sexual function; (vi) the impact that taking this step on this treatment pathway may have on future and life-long relationships; (vii) the unknown physical consequences of taking puberty blocking drugs;

This ^^ needs to be spelled out to anyone involved in treatment, and consented to.

No more vagueness, bright bright surgical light on the nature of the treatment.

And not just people undergoing treatment. This needs to also be properly covered in media stories etc.
BringMeTea · 01/12/2020 11:55

Bloody well done Keira and team!

MammothMashup · 01/12/2020 11:55

He needs to be very careful about what he publicly says about those drugs.

nauticant · 01/12/2020 11:56

We're building a list:

  • "We never said born in the wrong body or if we did we didn't mean it"
  • "The Keira Bell case changes nothing, consent was required before, consent is required now"

What other counterfactuals are there?

Needmoresleep · 01/12/2020 11:57

A big thank you also to Susan Evens, her husband and to all those within GIDS who followed their consciences.

Brave, honorable, people.

yourhairiswinterfire · 01/12/2020 11:57

That's fantastic!

It really is, I'm so chuffed for her.

I can't imagine how she's been feeling through all of this. Putting her name and face out there in the first place, when she'll have been very aware of the treatment such women receive, was so, so incredibly brave, I could never imagine doing it myself.

Amazing young woman. Truly amazing.

MindTheMinotaur · 01/12/2020 11:58

I would expect a charity focussed on support of transgender children to be ripping into the poor quality of evidence and treatment from GIDS and seeking to hold them to account. Surely that's what typical advocate groups would do?

MammothMashup · 01/12/2020 11:58

Does "Lifesaving medical treatment" count Nauticant?

It really sounded like that didn’t it!! 😮
RedToothBrush · 01/12/2020 11:59

Do you mean individuals who prescribe off label drugs to children, outside the nhs? Wonder who that could be?

I wasn't thinking of a particular individual when i posted but it has to be said that there would seem to be a problem with prescriptions for under 16s now even if they have been written by someone living outside the uk.

If the pharmacy operates within the jurisdiction of the high court and they are supplying experimental drugs to minors who can not consent and their parents haven't sort a court order to give the drugs to their children then there is a bit of an issue here.

How could any pharmacy continue to fulfill these prescriptions without themselves being caught up in legal implications?

nauticant · 01/12/2020 12:00

Predictably:

MammothMashup · 01/12/2020 12:00

He's also says:

But, of course, the decision only covers prescribing practice in the NHS - which was already an international outlier in terms of its institutional hostility to gender dysphoria.

So, don't go via nhs.

  • We never said there was no such thing as biological sex. But it IS on a spectrum.....
