"We are delighted to announce that a high court judge has looked at the case against Oxfordshire County Council (including their defence) and found that it is arguable that their Trans Inclusion Toolkit is unlawful. The case will therefore proceed to a full trial later this year.

We understand that the Director of Children's Services and the head of the Council's legal department who fully supported the implementation of the kit (which was reviewed & approved by Oxfordshire Safeguarding Children's Board) have either left or are in the process of leaving.

This case is of crucial national importance. If the court decides in favour of the 13 year old girl who is taking legal action, other toolkits and resources that have similar elements, and are supported by Allsorts, Stonewall, and others are likely to also be unlawful.

All the background and press coverage can be found at safeschoolsallianceuk.net. We would like to thank the teenager for taking this step to protect the safety, dignity and privacy of all girls."

See their Facebook and Twitter accounts for details.

Interview by Posie Parker with Tracy Shaw from Safe School Alliance describing the nature of Safeguarding issues & the origins of the group

2fallsagain · 18/04/2020 22:53

Thanks for sharing that interview Rowantrees.

I see there are some questions. I will come back tomorrow. Life got in the way today. I can report that it's been our most popular twitter thread to date!

TalkingtoLangClegintheDark · 18/04/2020 23:50

Thanks Xanthangum, that looks really interesting.

lionheart · 19/04/2020 02:23

Good news. Smile

langclegflavoredbananamush · 19/04/2020 04:13

What a refreshing breath of sanity. Too bad it takes so long to go through the system. Very much looking forward to the trail, and hoping it gets decent media coverage. (always the optimist...)

NonnyMouse1337 · 19/04/2020 07:41

This is a great start! Glad to see it's been given the green light to go ahead.

WhatKatyDidNot · 19/04/2020 09:33

This is such good news.

Times today,
'Girl launches changing room privacy case'
(extract)
A 13-year-old girl who objects to sharing changing rooms with transgender pupils has been granted permission by the High Court to take landmark legal action against her local council over its schools policy.

She is seeking to quash guidance from Oxfordshire county council that transgender girls can use female toilets, changing rooms and dormitories on school residential trips, and take part in girls’ sport.

The teenager said this gives her “no right to privacy from the opposite sex”.

The legal action is the first of its kind and could have implications for hundreds of schools that have adopted similar guidelines.

The council “utterly refutes” concerns that children are being put at risk.

The girl’s mother said she was “astounded” that her daughter was having to" (continues)

Thank you chit that R0wantrees. I’m frustrated by the emphasis being put on trans’girl’ as people who don’t understand, quite often think that is a female who identifies as trans, rather than a male who wants to be identified as if they are we’re a girl. At least they add the bit about sex, but only because the young girl used the term. Good that the news is out there, but a rather weak bit of writing by that reporter.

R0wantrees · 23/04/2020 10:28

It also contains an innacuracy which should be corrected.

"A 13-year-old girl who objects to sharing changing rooms with transgender pupils"

The issue is not with sharing changing rooms with pupils identified as transgender but with being required to share with peers who are male. The girl is not objecting to sharing intimate spaces with female pupils identified as transgender or non-binary.

The laws were definitely not designed to force teenage girls to change with teenage boys, nor force adult women to change with adult men.

It's lobby groups who have led people to interpret it that way.

Hopefully, this will shine a massive amount of sunlight on the fact that they don't need to, and are perfectly within their rights not to.

Also, the defence narrative will not only expose the utterly vacant argument over how boys can also be girls and all the sexism that underpins that idea, it will also highlight the huge campaign to ignore women and girls' boundaries.

We know that the only arguments are debunked stats on suicide and exhorting women and girls to be nice.

So let's hear it.

Aesopfable · 23/04/2020 11:15

The laws were definitely not designed to force teenage girls to change with teenage boys, nor force adult women to change with adult men.

Or force teenage girls to change with adult men.

SarahTancredi · 23/04/2020 11:19

Yes it was a bit disappointingly vague the article wasn't it.

Deliberately didnt make it clear she is objecting to biological boys being there.

Datun · 23/04/2020 11:30

Or force teenage girls to change with adult men.

Quite.

2fallsagain · 23/04/2020 22:17

If people could write to the Times pointing that out we would really appreciate it. We have pointed it out to the journalist but letters from the public would be helpful. Thank you.

MoleSmokes · 30/04/2020 06:27

There are several comments on this article claiming that it is inaccurate and a 13 year old girl (they all mention her sex) cannot legally take a case like this and it is actually the parents doing it or, alternatively, that she is taking the case but that the parents are using her as a front . . . I suspect the same people who gushed, "brave and stunning!" when male scholar Madigan bragged about instructing solicitors to sue their school (without even bothering to let their parents know).

2fallsagain brilliant work by Safe School's Alliance!

Now that the Judicial Review for Oxfordshire has been granted, does that put a stop put on Oxfordshire implementing the "Trans Inclusion Toolkit for Schools 2019" until the outcome of the Judicial Review is known? If so, would that apply to its implementation elsewhere?

Same question for the CPS Schools Guidance if the application for Judicial Review is accepted:

Aesopfable · 30/04/2020 08:25

Why do they think a 13 year old girl can't legally do this? Do they think she doesn't have capacity? Can't consent? That this is beyond her understanding?

Jintyfer · 30/04/2020 09:14

@aesopfable I like where you're going with this. Good train of thought!!
