"We are delighted to announce that a high court judge has looked at the case against Oxfordshire County Council (including their defence) and found that it is arguable that their Trans Inclusion Toolkit is unlawful. The case will therefore proceed to a full trial later this year.

We understand that the Director of Children's Services and the head of the Council's legal department who fully supported the implementation of the kit (which was reviewed & approved by Oxfordshire Safeguarding Children's Board) have either left or are in the process of leaving.

This case is of crucial national importance. If the court decides in favour of the 13 year old girl who is taking legal action, other toolkits and resources that have similar elements, and are supported by Allsorts, Stonewall, and others are likely to also be unlawful.

I notice they quote the made up suicide and self harm stats at the end of the article. Just so you know that this 13 year old girl is evil and will have blood on her hands. Arseholes.

But now we wait for the EHRC guidelines and they have shown their intent to misrepresent the law.

I'm disappointed as we really need a court case to expose how girls are being groomed to ignore their boundaries and erode their right to consent in all of these trans guidelines.
But- there are countless other local authorities with equally anti safeguarding guidelines so maybe another local authority could be challenged? Even the Cornwall guidelines (which are marginally better and more respectful of the issues) still advocate parental alienation.

How many years have the EHRC been stating that they're about to issue these guidelines? I recall that the leaked draft guidelines were spectacularly awful - it would be a great pleasure to see those unpicked in court.

Regarding the EHRC, I'm pretty sure that David Isaac (formerly of stonewall) is supposed to be leaving this year. I'm pretty sure he was only supposed to be there for 4 years. There was a big thread about him last year with lots of resources on him including the details on the controversy around his appointment. I'm pretty sure that's where I read it, I'll try and dig it up. Also agree that it's a shame the JR won't go ahead. We need test cases (which is probs why they've dropped it, they always knew it was bloody illegal!)

Could she put in a complaint to the LGO? Not nearly as good or as powerful but it doesn’t need a ‘live’ document in the same way.

I am disappointed this is not going to JR though.

In terms of the guide, SSA having been granted JR, with the apparent response being to withdraw rather than defend legally - even without the JR to nail it as unlawful, having the court confirm it likely to be unlawful hence granting the JR, it does change the landscape in terms of challenging any other authority who has failed to withdraw their version. Because the prospects of success in legal challenge are now more tipped in SSAs favour. And that risk isn't something any sensible LA wants to take in light of what's already happened. The fall back on waiting for the EHRC is probably practical albeit pretty spineless. God forbid they acknowledge girls have rights that should be respected. But the pressure is now on EHRC & there is far more scrutiny so the endless delay suggests that the writing on the wall is getting harder to ignore.

The momentum for adopting these guidelines has been the fear of legal action from LGBT orgs/EHRC have been actively seeking test cases - given the endless self serving training on equalities that had put everyone on notice any objections are transphobic & those transphobes will be purged, the LGBT orgs have been overly confident they could not be challenged on their 'mission'. It's about time they were made to account for their blatant disregard for girls & their rights.

Part of "sorting it out" has to be that "gender issues" are no longer distorted by undue influence from "a:gender", the Civil Service trans-promotion wing that enables cross-dressing males to determine Government policy affecting women.

a:gender is based in the Home Office and has a Home Office email address - what other Civil Service Special Interest Groups are embedded in Government in this way?

This paragraph from the Times article gives great hope that it is legal challenges which will eventually cause the entire house of cards to collapse....

^Her lawyer, Paul Conrathe, from Sinclairslaw, said: “[The document] plainly misrepresented the law by assuming that an array of gender identities had protection under the Equality Act. They do not.
“The toolkit advised that biological boys could access girls’ toilets, changing rooms and dormitories on residential trips. Rather than protect and promote the welfare of children, it exposed girls, in particular, to a greater risk of harm. The High Court has already considered the toolkit and ruled that it is arguable that it is unlawful. Oxfordshire safeguarding board have done the right thing in withdrawing it. It was plainly legally indefensible^
