Hammer thief sentenced to jail then judge immediately changed sentence purely because being transgender is more relevant than threatening a shopkeeper with a clawhammer.

It is time for third space within men's prisons where trans women can be securely and safely held to serve their sentences, and away from vulnerable women prisoners. It must be possible.

I think that these ads are the one place you get honesty about this stuff.

So in this case Layla should have been sent to male prison based on legal gender, a case board convened, and then transferred to women's prison on the basis of fairly conclusive evidence of 'living as a woman' within 14 days.

I don't know why instead they just let Layla go.

I would also note, en passant, that I'm assuming Layla is named for Anton LaVey, judging by Layla's FB, which is devoted to the occult.

I find it quite confusing when someone is variously named after a satanist, called 'Candice', 'Adam' and 'Marcus' to know what name is supposed to stick. Presumably one of these is a legal name.

I don't get this. Who is more vulnerable to attack than a paedophile rapist, yet they arent let off because they will be attacked. Allowances are made for this in their accomodation. Why isn't the same thing done here?

Hang on - i remember reading of a woman who got 10 months in jail.

She was an addict who aggressively offered a man (who had given her a handout) sex for money. She turned up at his front door then and chased him around his house trying to hoist herself into him. No weapons.

He was terrified of being raped and she was jailed for attempted rape (actual rape gets less these days).

Violent sex worker alcoholic Le Fey was released to stay in a women's refuge instead of to going to male prison on grounds of safety and dignity. WTF.

I think the judge is well aware that the defendant is post-op. This statement points to it : "But there are circumstances where it can be regarded as disproportionate in a society that acknowledges diversity, but has a lack of resources otherwise to deal with it."

So a judge doesn't think a man* without a penis should be in a men's prison. But doesn't think they should be in a women's one either (I suppose we should be thankful for that - they've learned something post Karen White although I don't think this particular offender is sexually interested in women).

So the answer shouldn't be that they can evade incarceration altogether surely? There must be other vulnerable men in prison. There must be plenty who sell sex to other men.

This case is outrageous. This is a violent, recidivist criminal. 50 previous cases. It is being reported in the Daily Mail. Public confidence in the police is at an all time low. A violent recidivist hammer wielding criminal escapes prison because transgender? How is this justice? The judge's comments are a grim insight into the bankrupt ideology behind this bankrupt decision:

We live in a society which acknowledges and embraces diversity and allows and encourages people to live the life they want to. Sometimes society does not make the necessary or appropriate adjustments in all ways it can to reflect the adjustments of society as a whole.'

Of course this will be recorded as a female crime. That’s why we are constantly being told that female crime is increasing, especially violent crime.

Judge Mooney was appointed to be a Circuit Judge in April 2019. However in his short time in the post, he has already had one of his sentences reviewed and issued an apology following accusations he was too lenient
