I'm not saying it is true - Twitter isn't known for being wedded to truth...anyone able to shed light? I thought the verdict wasn't due for a while...

I'm fuming and depressed. The judge has basically said that a belief in the scientific reality that there are two immutable sexes is not worthy of respect. And that is not good enough to use preferred names to someone's face. You have to actually believe they have changed sex.

For those who have asked about the process for appealing, appeals can be made to the Employment Appeal Tribunal on a point of law. Then the Court of Appeal. Then the Supreme Court. Then the European Court of Human Rights (potentially).

TirisfalPumpkin · 19/12/2019 07:41

More than ten thousand spades were deployed to the hole overnight.

It still feels gutting even so. Also slept badly. I want to give Maya a hug.

I guess we have to hope for an appeal, Harry’s case going well, and all get writing to our MPs about this absolute insanity. Tory-shame them. If your seat like mine has gone blue, your MP should support classical liberal freedoms of thought and belief even if you think they’re right wing gits.

NotAssigned · 19/12/2019 07:44

I have my spade at the ready Maya.
It's clear if you do appeal this funding is one thing you don't have to worry about.

If the Conservatives do not urgently address the existential threat to freedom of speech and thought which is becoming more explicit by the day, they should hang their heads in shame. As for judges being ‘right wing’ clearly not. This ruling and its implications for freedom of speech is just incredible

NeurotrashWarrior · 19/12/2019 07:49

Posting on the hop and not rtft.

There will be reports on this. More sunlight. More analysis. The crap science. More exposure of the bat shit crazy.

Courage calls for a lot of noise.

BovaryX · 19/12/2019 07:57

The Claimant largely ignores intersex conditions and the fact that biological opinion is increasingly moving away from a (sic) absolutist approach

I note that the rare anomaly of ‘intersex’ is being used to justify a denial that humans are dimorphic. I am not a scientist but I would like to know what scientific basis is there for the judge’s assertion about ‘biological opinion?’

SoldiersinPetticoats · 19/12/2019 08:01

Justin Webb is going to cover Maya’s case on Radio 4 shortly. He did a great interview with Jo Swinson so hopefully will be good daylight.

VinandVigour · 19/12/2019 08:01

It is going to be on R4 in the next hour.

NeurotrashWarrior · 19/12/2019 08:05

Good. Sunlight.

HandsOffMyRights · 19/12/2019 08:06

Thanks Soldiers he did a great job with Jo.

I wonder if this will wake up those doubters who thought we were being OTT, who thought TW were a minority of 'Danish Girls' and who wanted nothing more than to share our powder puffs and fix our hair in the changing rooms Confused

This is very real. But once again, if it doesn't affect men, then why should they care?

BovaryX · 19/12/2019 08:06

From the ruling

Everyone has the right to freedom of thought, freedom to manifest one’s belief shall be subject only to such limitations as are prescribed by law and are necessary in a democratic society

Who decides which thoughts are incompatible with a ‘democratic society?’ If belief in the immutability of biological sex is not compatible, that suggests freedom of thought has been seriously restricted in service of a niche ideology.

OvaHere · 19/12/2019 08:08

Human Rights Barrister going to be on R4 after 8.30 discussing case according to tweet from Justin Webb

A man who has repeatedly clashed with Maya and refused to report on sex based rights via his org.

RealityNotEssentialism · 19/12/2019 08:10

Yeah the human rights barrister is the personification of woke bloke and totally insufferable and mansplaining. Awful choice.

OvaHere · 19/12/2019 08:11

He's one of those anti women, pro prostitution type human rights lawyers.

OvaHere · 19/12/2019 08:12

Basically he's a Men's Rights Lawyer.

boatyardblues · 19/12/2019 08:15

What a shitshow! More than happy to dig for an appeal, if you still have more fight in you Maya.

BovaryX · 19/12/2019 08:15

Good choice BBC. What about having someone who can analyse the way freedom of speech and thought is being cribbed and restricted in sacrifice to a niche ideology?

TimeLady · 19/12/2019 08:15

Sounds as though the judge was on the same training course as PC Gul and is intent on checking our thoughts.

The press seemed to have recognised that this and Harry's case were important in terms of freedom of speech. It's not in their interests to ignore this either

NotAssigned · 19/12/2019 08:15

I'm really unhappy with the Tory victory but this is at least one area where it may be useful.

I'm telling myself that it's perhaps a good thing that this case lost at a low level court because it means it can go up the court structure and have much more sunlight.

TirisfalPumpkin · 19/12/2019 08:27

Also clutching hope, Maya winning at this stage would also not establish a legal precedent/case law, so opponents could just claim flukery or bias.

The bit that really grinds my gears is the idea that a GC belief is absolute and never challenged by the holder. Most of us will have many beliefs and opinions, but this is one of the hardest and most challenged views I’ve held. You have to be well read in, endocrinology, neuroscience, sociology, linguistics, formal logic and then some - all of which will present challenges and oddities to what seemed like a fairly simple proposition, and then you have to be nice and not say any of the ever-growing list of proscribed words. All the opposition have to do is assert ‘I am right’ as rudely as they like, and it seems to carry equal legal weight. They’re never asked to question whether they really are right or their belief stands up to examination.

Not being an absolutist I’m not sure why this is, but I think it has something to do with penises.

Forgotthebins · 19/12/2019 08:37

If that lawyer is Adam Wagner, then even though his charity has put forward some misogynist material before now, even he seems to be saying on Twitter that there are grounds for appeal.

EverardDigby · 19/12/2019 08:37

Surely the headline is that you can be sacked for saying there are two sexes. I'm not sure the articles so far have brought this out.

BoreOfWhabylon · 19/12/2019 08:40

Justin incredulous.

Wagner actually says judge has gone beyond his remit!

Birdsfoottrefoil · 19/12/2019 08:40

I do hope Maya has the strength to appeal. If so, then this dreadful judgement may have a silver lining by boosting it up to a court which can set precedents.
