When discrimination on the basis of a protected characteristic is alleged, the Courts will (and have done - Royal Mail) compare the treatment of someone without that protected characteristic, with the alleged treatment of someone with it. This is in order to ascertain whether or not the person has been discriminated against due to their characteristic. In the case of a TW undergoing gender reassignment, the comparator is a natal male NOT undergoing gender reassignment. Please note the comparator is NOT a natal female.

Secondly, as far as I can see Centerparcs did not discriminate at all. The TW was not turned away because of their gender reassignment status. They were not refused treatment, or treated less favourably than any other person. They were welcomed and provision for them to partake of the activities and treatments offered was made.

Often TRA and MRA forget what discrimination actually is. Telling someone they cannot use any toilet because they are a male who identifies as a women is clearly discrimination. Telling them they have to use the male or unisex toilets is no more discrimination, than someone telling me (natal female) I have to use the female toilets is.

How do you tell the difference?
I don't think appearances are what we should be judging. If you're transgender and are covered by EA2010 protected characteristic of gender reassignment, requirements have been met.

Well perhaps you should take your own advice and stop judging appearances in that case. You erroneously claimed appearances would count. I couldn't care less what the transwoman looks like.

My question to you was how can we tell the difference between a transwoman, a rapist, paedophile and a cross dressing fetishists? You seemed to think it would be something to do with appearances. Which you now, presumably, realise is incorrect

What is driving my question is wanting an answer, strangely enough!

Or don't you think women and girls should be able to be in a position to exclude cross dressing fetishists, rapists, paedophiles and predators while they are taking their clothes off?

And I don't know how many times people have to tell you that the comparator for those without a GRC is other men. Those with a GRC are vanishingly rare.

It’s relevant because you speak of TW living as “a woman.” And identifying as “a woman.”

You cannot logically argue that TW do either of those things if you cannot define the word “woman.”

Exactly, Datun. And they know that if they were to say that, the inherent sexism would stand starkly revealed.

That’s why they refuse to answer. They know, deep down, their own misogyny. It’s not something they’re ashamed of, but it’s something they know won’t wash politically — at least, not yet. Not unless and until they can completely undo all the successes of the Second Wave wrt sex-role stereotypes by inculcating the notion of the gender jelly-baby spectrum into younger generations — permanently imprisoning them at the toddler stage of understanding sex difference, wherein a girl becomes a boy by cutting her hair and a boy becomes a girl by growing his out.

So yes you must support them, but yes you can still do things single sex , communal accommodation being a given example, competitive sport where there is a physical advantage another, and things when risk assessment is a key element ( focussed on insurance but I guess that should be equally true in prisons)
