And she’s caught between that and what JY wants as ‘validation’ and their ‘rights.’ This is where we are; seemingly no further forward than a fucking century ago - and all in the name of ‘progression.’

I don't think this has been answered. If you're offering a service, are you compelled to provide it to anyone who asks, or can you just decline? And if you're offering a service only for women, why can't you decline to offer it for someone who is male? That's on the grounds of sex, not gender identity (or whatever the protected characteristic is in Canada).

Not a Canadian lawyer but have been doing some reading " most provinces permit discrimination on the basis of sex on the grounds of “public decency” or privacy. This exception protects spaces where people may be in a state of undress or receive personal care (think: spas, women’s detention facilities, or personal support workers)." for example this case where a man wanted to attend some women only gym sessions www.canlii.org/en/bc/bchrt/doc/2016/2016bchrt86/2016bchrt86.html

The question I can't find an answer to though is does Canada believe JY's sex is male or female. If sex is female then it may come down to "gender identity", if sex is male then its pretty clear that they shouldn't have to provide these services.

Goodness knows what Canadian law might say but in the UK, a business can decline any client they don't want as long as the reason for doing so is not a protected characteristic. Businesses do this all the time.

The reason for refusing can be serious or trivial but as long as it not based on a protected characteristic, it doesn't matter.

But his argument is that by calling him out as a male it was based on a protected characteristic. Of course SG also said it was because he lived outside her area. But that didn't count apparently.

SG about to be questioned. I have to say I'm horrified this hasn't already been thrown out. It's abuse to put SG on the "stand". And JY has TWICE been communicating in the court. Never mind their parent disturbing the proceedings. It's starting to become clear how characters like JY are formed...

I'm wondering how the member knows that someone is communicating though. If JY is allowed online then there would be internet activity into/out of the room. I cannot see how the non-ID of JY is still continuing. Just because MM's followers are so scary?!!

I'm aghast that SG is going on the stand and I don't want to read, it feels intrusive, but I also feel it's important to witness what is happening here. Important to witness what he's doing, with a view to somehow standing against it, rather than turn away because it's horrible.

I'm not quite sure what's going on with the lawyer and SG because this line wasn't followed. She was asked how she felt at one point but that was it.

I really wonder how this would be playing out if it was a betesticled person with no reputation, who was capable of acting sane and articulate, who chose their targets more carefully.

I suspect they might be getting more media coverage.

Totally agree. I've been wondering about this. I'm not sure of the remit of a human rights tribunal. I'm not sure if it's considering all the human rights in the decision or if it's only considering whether JY's human rights were breached. I am concerned it's just the latter.

Perhaps there's no desire to do woke pro bono if reporting has been restricted...?

Wow, just caught up. The parent is as much of a disgrace as YV. I take back my earlier opinion that they're working off concern for YV only.

No decent human being could applaud a woman being forced to touch male genitals against her will, add to that that JY is unstable and unpredictable and I'm not at all surprised no firm took them on pro bono.
