I have asked the woman who does my laser treatments if she would treat a trans person or a man and she said no, she chooses not to treat a person with male genitalia.

I've worked with a local network of holistic therapists doing massage, Reiki, ear candling, reflexology etc, and most are women with a therapy room at home. All take women clients via phone or email contact, but have a policy of men only if they are known to them or known to a friend or a long term women client. Several have been sexually harassed or assaulted in the past by male clients. All have said if they are no longer allowed to clearly establish if someone is in reality female and state their own boundaries, then they will simply stop advertising and will pick up clients only through friends and acquaintances and personal recommendations.

Basically go underground like the lesbian groups and women's support groups etc.

When I worked as a therapist I was in a small windowless room with my client. Of course I was watching them all the time but if I felt uneasy I’d leave the door open or say that I was having a trainee observe the session. I’d also say that I was recording the session for them.

This was pretty standard for the clinic - men and women - but the reasoning there was just in case they tried to attack you, or accuse you of something inappropriate. Not in case you literally tried to kill your client by calling someone by the wrong pronoun.

Really I think anyone who provides home services should be able to refuse anyone, no questions asked. I have massages with a female therapist and she only accepts men if they are partners/friends of women she knows - obviously she loses clients but experience has shown her that the risk of assault is too big if she accepts anyone. Laws really need to take into account the reality of male violence. It is ridiculous that this person is saying that gender equality is not being respected- women are greatly disadvantaged in this scenario.

This is actually the way around it if the beautician thinks someone is with make genitalia identifying as a woman. Especially in Canada, where there's no training for cock and balls waxing but IS for vulva waxing.

Im actually concerned that this training issue is going to be turned on it's head somehow and the fact she didn't give it a go - because no training available being read as required - will bite her and the other women.

Maybe that's why they are talking about her religion? That's she's objecting on religious grounds, not because she isn't qualified. She can't say she isn't qualified if the qualification doesn't exist?

I'm surprised that there isn't a recognised qualification - who wants that done by a keen, or not so keen amateur?

Not rtft but has anyone mentioned training? For insurance purposes therapists shouldn’t practice outside their training. Differences in genital skin?
Also it might not be picked up by a lot of media if it’s clear person has serious mental health issues.

This is second of three cases that have been grouped together and in which defendant is represented by @JCCFCanada lawyer.

There is background on first thread about the BC Human Rights Code and the Tribunal. JY has made 14-16 complaints about being denied waxing services. From info heard in last hearing, it appears that some have been settled in mediation.

So we can expect Canada to be changing it’s content for therapist training.

Reading the updates from Day 2 I feel so immensely sorry for these women and even embarrassed that this is happening to them. I hope that this case is printed in India, Egypt, Pakistan, China etc - whichever countries have the largest number of immigrants going to Canada. Canada is held in SUCH high esteem (I know one of those countries personally and to move to Canada is a dream for many) by people all over the world. If they knew how these women were being treated, it may change their minds a bit - or at least forewarn anybody wanting to move there.

Who is representing this person? Where is the money coming from? Will their neighbours show their threatening tweets? Will they sort out their gas problem? Will they ever get their bits waxed - and will they sue because it bloody well hurts on a woman so god only knows how it feels on your knackers...

The Tribunal member's previous statements have explored the decision to consolidate JY's complaints with a view to reducing the resources needed from everyone given the limited resources for HR challenges in BC.
