Glad he's a situational offender, let's just keep our fingers crossed he's never in the situation where he's with someone he could feel curiius and immature enough to abuse again. Say, them lying sedated on a chair and him in control.

Within our current society there literally is no deterrent.
I look at my my beautiful, innocent 4 year old and I'm sickened at the thought of predators out there who are probably hiding in plain sight.

I think the wording of the petition is so strong people are reluctant to sign. Sex offenders register yes. Prison, maybe not so much.

So, “I was just curious, M’Lud”, is now a valid get out of jail free card?
Along with “She was asking for it”, and “rough sex gone wrong” in murder trials.
Are there any circumstances left, under which victims can secure the conviction of their attackers? Or are all women and children now deemed fair game for any predatory male sex attacker to satisfy his “curiosity”?

If adult women who have suffered sexual assault and abuse as a child wish to change the narrative on its lasting impacts (or not), then they are abl to do so on their own behalf.

Meanwhile, I'm furious that a girl who was abused for two years between the age of 6 and 8 has been deemed (already!) to have suffered no lasting effects.

I’d also like to know how the researchers in the work you will cite differentiate between situational (family) and situational such as, say, a gymnastics coach or doctor who has spent years getting into the role so that they have access to children.

I would also ask you - if Christopher Daniel pitched up at your surgery, was assigned as your dentist and your six year old daughter needed dental work done under sedation, would you allow that unsupervised?

I wouldn't leave any child unsupervised with any male HCP in any health care setting.

Child sexual abuse is unforgivable

I think the act is abhorent, I think in some instances the abuser can be rehabilitated and become a worthy member of society. I don't know if that's forgivness.

My argument isn't and never has been that he shouldn't be punished.

My view is that the lack of punishment stems from a failure in the sentencing guidelines, caselaw and the mandatory nature of the SRO and not from a desire of the Establishment to see a middle class boy walk away without stain on his reputation or from a conspiracy of paedophiles working to protect him.

That paper says people offend more when given the opportunity - it doesn’t prove that a purely situational with no planning/positioning offender is a lower risk. It exposes the fact that most offending is situational, not that situational is the cause of an offender being lower risk. It’s an important distinction.

The judge had the opportunity to not give a custodial sentence but instead to impose some kind of therapy or rehabilitation- he did not do so. The offender has been found guilty and given a total pass.

No rehab. No therapy. Nothing. No consequences at all,

There must always be consequences. Even in societies where the justice is aimed almost totally at rehabilitation there are consequences. Therapy/rehab etc. No one just walks away without even a slap on the wrists.

This is compounded by the secrecy. Without a public record of WHY the offender got away with zero consequence, public faith in justice is undermined. Because we dont know if there are genuine mitigating circumstances (although I’m at a loss to think of any - other than a threat to his life) or if it’s a case of nice Middle Class Boy whose daddy is in the Rotary.

Those conditions breed vigilantism- and that’s not somewhere we want to go.

Yes, because as the sentencing statement reads The notification requirements of the Sexual Offences Act 2003 would automatically apply to a conviction for this offence unless an absolute discharge was granted.

I don't know what I'm reading into the sentencing statement that you're not but the Sheriff has explained why he granted the absolute discharge and what he took into account. The sticking point is the SRO.

Personally I would rather not demand specific punishments when we cannot know every detail of the case. I also - knowing nothing about the law, mind! - suspect demanding specifics is more likely to receive a flat "No, can't do that in law, sorry".

I don't know the person who started the petition or their motives. If this was a legal representative with a realistic chance of making a difference to either the flawed legal situation which allowed this, or to this case, I would be more likely to sign. As it is, this petition looks like a knee-jerk "hang the bastard" response. Understandable, but not something I can sign up to.

So you are prepared to make cynical assumptions and risk assess any and every male HCP as a potential risk to a young child, even those who are definitely innocent, but you don't think SOR requirements should apply to a man who definitely has sexually abused a young girl.

You personally assume any male can or may abuse given the opportunity/situation so take steps to avoid it yourself, but aren't prepared to say that as a societal level a guilty abuser should be kept away from children and so needs to be on the SOR for a length of time.

How on earth do you square these two reasonings?

You have been asked what you think should have been the consequence or punishment, but you cop out by saying you don't know.

I just cannot make sense of your views on anything.

Every single person found guilty of sexually assault should receive a custodial sentence. The courts need to send a strong message that this sort of abhorrent behaviour will not be tolerated.

I really can’t think of any circumstance where it would be appropriate for the perpetrator to be let off in this way.

It seems to me that as far as sexual offences are concerned that the U.K. is going backwards. Victims really don’t matter, not even little girls aged who were assaulted over a 2 year period.

I'm looking back to see if someone has outlined why it's situational and perhaps not been considered an attraction to children/ future risk to other if the offences occurred over 2 years? 2 Years?!

I don't want to feed trolls or disturb anyone but my mind boggles at this. Thanks blistory for explaining some of the actual legalities. I too balk at the wording of the petition but wonder if signing it at least registers (to no one?) a crude questioning of what's not working in the legal system.
