They’re a fucking disgrace, what they’ve allowed/are allowing to happen to young girls, can’t get them round for a burglary for love nor money, but put up a satirical video about mutilatuon children, they’re round like a shot. Summary of the above video for those short on time: The police never say "Anything you say will be used to defend you in court" because the phrase is "used against you" - it is against - always.

Anything you said that might be helpful to you can be left out - they have no duty to disclose anything that counts in your favour, and any tiny slip-up you make may be quoted out-of-context.

Worse still, if it is just "a casual chat", then it means that there is no formal record of what you said. They can claim you said absolutely anything in order for them to "tidy-up" their case against you.

The video has some shocking examples and is very thought-provoking.

'Voluntary' interviews are covered by the Police and Criminal Evidence Act. What you describe is nothing like the procedures and processes that the police have to follow.

I give you, for example, the detailed policy and procedure from Surrey Police' here:

Failing to follow that procedure puts a case at risk of being thrown out.

I cannot speak about the practice in the USA but in the UK the caution is as follows: ""You do not have to say anything, but it may harm your defence if you do not mention, when questioned, something which you later rely on in court."

It is also important to know that a non official Police conversation or a comment taken from any form of media may not be a true reflections of the facts.

ClingFilmApplication That video is from the US. UK law is different - there are also differences between Scottish law and the law in England & Wales. Best to look up location-specific law before trying out '5th Amendment' stuff on your local bobbies!

In the UK, the police are allowed to stop and question you at any time....
...However, you are not obliged to answer these questions and cannot be charged for not doing so. You can walk away or say ‘I am using my right to remain silent’, just make sure you do so in a calm and polite manner. Without further evidence to suspect criminal activity, you are free to continue your day as usual.
