I haven't commented on this thread earlier because I don't have strong opinions on surrogacy, but there was something a bit Handmaids Tale about the birth announcement- like the actual mother was totally irrelevant. That however is a wider issue than this one case.

Yes. The parental order works like an adoption order to extinguish the surrogate mother's legal status. If the man of the commissioning couple (the legislation, not my words) is named on the birth certificate, the parental order would extinguish that anyway. Only a couple can apply for a parental order, not a single person.

There was a recent case where a single man commissioned a surrogate. He was the biological father. He asked the court to make a parental order which they refused to do as it can only be made on an application by a couple. He could rely on his biological parentage, but that would not extinguish the mother's status. He could potentially apply for adoption, but would have to go through the legal process (which is much more extensive than surrogacy).

It shows that we all need to comment in a mature way, because by dropping to the level of calling them wankers we now all look like bigots. This thread has some really insightful and valid points about surrogacy and the ethics around it, but the article makes us look like regressive homophobes because they were able to screen grab the few personally insulting comments.

What is the main difference between all the celebrities 'who haven't been criticised' (except they have).

Is it because Tom Daley is gay. Or is it because Tom Daley is British and is circumnavigating our law, and his partner is complaining about our law being too strict?

Thus comments about why our law is right and why the practice of commercial surrogacy is abhorrent and we shouldn't be sucked in by the bullshit coming out of the mouths of Tom and his husband, and even remotely consider relaxing the law (which is one of the reasons those two are rabbiting on about it, cos that's the agenda).

As I said before, it seems hiding behind the smoke screen of 'oh your so homophobic' and trying to reframe the debate as being something completely different to what it was seems to be all the rage at pink news.

It's almost as if they hate women. And worse, they hate women having an opinion.

They can piss off.

Presumably arrangements are entirely different in USA given that surrogacy is now fairly common over there. And Dustin is American, won't the baby have American citizenship? Would they need to jump through the hoops of UK law when they come over here with the baby?
Just interested in nuances and practicalities of the law here.

It's interesting, I've seen very strong criticism of this surrogacy arrangement all over twitter, Facebook and underneath various news articles. Particularly on twitter some of the fiercest opposition I've seen has come from men. Funny how Pink News ignores all of that and focuses entirely on MN feminists having the audacity to discuss the ethics of surrogacy.

For all those morons carping on about the necessity for a child to be with its mum, I'd suggest you open your eyes to the world at large and see that simply being a mum does not make you a) maternal b) a good parent or c) automatically immune from totally wrecking your offspring's childhood. There are millions of wonderful mums and dads and (sadly) millions of utterly shit ones. Who knows if Tom & his husband will be great parents? Nobody. That's who. And neither do we know whether their child would have a 'better' upbringing with its birth mum. So STFU and go and get an education.
