The legal difference between a cake and a biscuit is that a cake goes harder when stale and a biscuit goes softer when stale
So, jaffacakes are cakes, and cheesecakes are not, they don't even really go "stale" they putrify if off!

If you replace the biscuit base of the cheesecake with a brownie base and a baked cheesecake layer on top (DOOOOO IT!) then it's kinda a cake
