What I don't get,is why the first one got off..in my mind they are both vile rapists...

Twogoats · 04/10/2016 20:20

Out of interest, who is paying for all this?

morrythou · 04/10/2016 20:21

"why can't he be a man about it"....where to start!

FreshwaterSelkie · 04/10/2016 20:23

Let's face it, it doesn't really matter what the outcome is does it?

If he's found not guilty then she will have people hounding her for her blood - "she's a liar!", "she should be thrown in jail", "she ruined that poor man's life" etc.

If he's found guilty again then she will still have people after her blood - "she got him sent back to prison again and ruined his life again!" etc.

Either way she's going to have people out to get her Sad

snakesalive, the closest analogy I can think of would be to say that, imagine you and your partner booking into a hotel room and starting to have (agreed) sex. Part-way through, a stranger enters the room and joins in (after asking your partner if he can "have a go.") You consented to the first "encounter," but not the second, as it was a complete stranger, who you'd never met before him entering the room.

morrythou · 04/10/2016 20:35

..and whatever the outcome he will still always be regarded as a rapist by large section of the public.

ToadsJustFellFromTheSky · 04/10/2016 20:36

I doubt that.

Rape isn't judged quite as black and white as most crimes as there are really 2 parts to finding someone guilty and it was on the second part that the other man was found not guilty and it was to do with having reasonable belief that the woman consents, basically because she went back to the hotel with him it would be reasonable for the first man to believe she consented. Ched Evans was in a completely different position as he came to the room later.

morrythou · 04/10/2016 20:43

"I doubt that"

I'm sure that will be of great comfort to him.

BoneyBackJefferson · 04/10/2016 20:56

pinkblink

I suppose you could say that if you disregarded the kebab shop, taxi driver and night receptionists versions of events.

snakesalive · 04/10/2016 21:03

I understood the whole thing to be that the first guy picked her up for sex,she was to drunk to remember..so how could she of given consent to either

snakesalive · 04/10/2016 21:05

Ella Saturday, with that thinking in mind, then any girl going to a guys room is giving consent to sex by going to the room.....I might be in the minority here, but I was amazed when the first guy didn't get charged with rape

BarbarianMum · 04/10/2016 21:15

I thought he was charged and was acquitted later at trial.

BaronessEllaSaturday · 04/10/2016 21:28

No one can confirm for definite that the jury acquitted him for that reason but it is the most likely one. The defense of reasonable belief in consent is in the legal guidance for the CPS. www.cps.gov.uk/legal/p_to_r/rape_and_sexual_offences/consent/#a04

There is a long way yet to go with regards to getting rape recognised properly for the crime it is in all circumstances.

AnchorDownDeepBreath · 04/10/2016 21:34

Does he go back to prison if he's convicted?

I was under the impression that he'd served his sentence and been released so he wouldn't go back, but I can't recall where I read that.

I can't imagine having to relive this again, either. I feel so sorry for the woman.

Dervel · 04/10/2016 22:35

My understanding is that although he is out of prison any prospect of him getting signed to play football again professionally gets quashed. Given the money involved in football this his shot at getting back to his career, if he gets a not guilty verdict he can play again. Thus we have the whole circus going again and putting the victim through the ordeal again.

Elendon · 05/10/2016 07:32

Evans is already playing for Chesterfield, in a professional context.

ChocChocPorridge · 05/10/2016 07:36

Jesus not this again.

He was convicted BY HIS OWN WORDS, HIS OWN EXPLANATION OF WHAT HAPPENED - not by that of the woman he raped.

What is the world coming to when a man can explain exactly how he raped a woman, and still people are excusing it as not rape?

Xenophile · 05/10/2016 08:36

Yes, this again.

So many people want to excuse this rapist from his crimes.

Even, I suspect the present jury in his retrial.

cadnowyllt · 05/10/2016 09:30

Guess we'll just have to wait for this new evidence then.
