For me there is enough evidence to state that she was not aware of what was going on. I do not believe that she was aware that someone else had entered the room. I do not believe that she was aware that she was no longer having sex with the same man therefore she can not consent to sex with CE. That does not mean that the sex couldn't be enthusiastic but that is a different thing entirely.

As I see it, before asking whether she consented or not, you first have to decide if she was capable of consenting. The drunkeness evidence, and things like the fact that she seemed to be extremely unresponsive when someone walked into a hotel room as she was having sex would seem to suggest she wasn't exactly all there. That is one thing the jury have to decide.

The second thing is CE might very well have believed she consented, but the question is was that belief REASONABLE given that he never bothered to actually talk to her BEFORE he started. So what was his belief based on? What information did he have as to her consent and capability to consent BEFORE he started.

But unfortunately that bit of evidence appears to have been swapped for 'she had had sex before and enjoyed it' Sad

Yes, its the reasonable bit. Would a 'reasonable' person walk into a dark hotel room at 4am on a sunday morning and penetrate a woman he had never met before within seconds without even speaking to her first? He says that she said 'yes' when cm asked if his mate could join in, but even if that's true, is that enough of a reasonable assessment of consent?

What I mean is that you can be enthusiastic about sex but if you have been deliberately misled about who you are having sex with then you haven't consented to that person and it is rape.

The appeal judges who overturned the original verdict on the strength of such shitty 'evidence' should feel ashamed, but I doubt it.
