Judges comments on sexual assault/rape

A case has been reported in my local paper where a 17 year old boy was convicted of oral rape and sexual assault of a 12 year old. He has been given 100 hours community service and put on the sex offenders register for five years. The judge said "I certainly wouldn't want to do anything which would prejudice his future career". A charge of rape was held on file.

I am so appalled that yet again, the career prospects of the sex offender are given higher priority than his crime and the possible effects on his victim. I seem to remember reading that people can complain to a higher judge (not sure the terms) about a judgement, but am not sure if I have imagined that through wishful thinking?

This is the news report

Here's a template to adapt to write to the Attorney General. This is just disgraceful.

TheDoctrineOfSnatch · 25/04/2014 19:18

Fucking hell.

pebblyshit · 25/04/2014 19:22

Just coming to post the same thing. It's crap. It was the same with the 'promising young men' in the Steubenville case. A man's good name is officially worth more than a woman (or child's) right to not be raped.

AskBasil · 25/04/2014 19:28

Not only the judge being clueless but this rapist has been posting on the Epsom Guardian's website that it was all his victim's fault:

Unbelievable

He has stated, on a newspaper website, that it wasn't his fault that he couldn't tell she was 12 - in other words, he's not responsible for his actions.

Surely taking responsibility for the crime is the minimum you need to do to avoid a prison term? But he hasn't even needed to do that. The judge has successfully given this rapist the message that raping 12 year olds is no big deal.

AskBasil · 25/04/2014 19:29

And as an aside, it doesn't help that he looks like a feckin' Obergruppenfuhrer.

RustyParker · 25/04/2014 19:45

He groomed her on fb, got her drunk, assaulted her, plead guilty and for all this he gets a slap on the wrist. Now he is abusing and trashing her in the press. Scumbag.

Am emailing the attorney general - thanks for the link AskBasil

Thanks for bringing this to our attention op

TheDoctrineOfSnatch · 25/04/2014 19:47

He pleaded guilty to oral rape and assault by penetration.

Under the age of 13, "she looked older" is disallowed as a defence.

He really needs to STFU as this case will be subject to sentence review.

weatherall · 25/04/2014 19:51

How did he get away with that when she's under 13?

There is no justice system in this country for rape and sexual assault.

TheDoctrineOfSnatch · 25/04/2014 19:51

"“, there was no "rape" in my eyes at the time (me being a young, immature boy) believed this to be full lawful activity."

You were seventeen, dickwad. She was twelve. Who was the "young, immature" child, exactly?

Cushionmonster · 26/04/2014 09:24

Thanks for that link, it's a really helpful website. I'll send in my complaint, and my family are going to do so as well.

CaptChaos · 26/04/2014 18:18

I've emailed my complaint in. I'll also tag it on my Facebook page. What an utter utter bastard. He admitted he knew how old she was ffs, and has since denied it. He is trying to convince himself and others that he's the victim.

ApocalypseThen · 26/04/2014 18:54

So even a proven, true complaint of rape isn't anything to be ashamed of, all the girl's fault. Contrary to the image that MRAs give about how an allegation ruins lives.

Qualified in 1969, hmmm. Wonder if he has connections with PIE.

CaptChaos · 27/04/2014 00:15

Interestingly, his athletics club's code of conduct from athletes specifically says that the athletes "Avoid swearing and abusive language and irresponsible behaviour including behaviour that is
dangerous to yourself or others, acts of violence, bullying, harassment and physical and sexual abuse"

Code of Conduct

Surely they now have to drop him as a participant? Presumably being on the sex ofender's register must also preclude him from taking part in activities with young 12 year old girls?

The comments he made are here

Careful though, people who think that convicted rapists should be handed down proper sentences are misandrists. I wonder if the jerk on there would think the same if it was his 12 year old daughter who had been raped?

StackALee · 27/04/2014 00:21

Interesting that the comments on that last link have shown how disgusted people are by the judge's decision and that they have pointed out the error of a rapist posting his own comments in which he excuses his behaviour and blames his victim. I hope there is a review and I am going to send the screen grabs to the Attourney General.

ApocalypseThen · 27/04/2014 08:20

Mind you, the defence that he checked her age thoroughly but she set up this elaborate web of lies to entrap him is interesting. Plays right into the female = deceitful trope, and also into the weird idea that there are gangs of marauding under age girls duping unsuspecting men into sex. I imagine this plays into the err... victim's sense that they are just that attractive, but really it makes them look like predators who've absorbed some myths about teenagers which aren't really very true.

AskBasil · 27/04/2014 08:31

I love the way that writing to the Attorney General is now considered vigilante justice if you're a rape apologist. Hmm

pebblyshit · 27/04/2014 15:26

Doesn't make it any easier to raise a son when they are told that being good at PE means they can stick their dick wherever they like.

Something I've noticed from the comments in this story is the 'but she consented' angle of the RAs. There is no acknowledgement that had she been 16, being driven into the arse end of arse by someone with greater physical strength and does not make for a situation where refusal to consent is free. Consent through fear is not consent. Consent through coercion is not consent.

NeedAdvice2014 · 01/05/2014 16:43

Sadly AskBasil my guess is that his appearance helped quite a bit. I wonder if a Black young man would have been given the same sentence.

Psycobabble · 01/05/2014 16:48

It's not like it was a couple if years difference say they were at school together and consensual like wen I was 15 bf 16 that sort if thing age 12 is a child !! He will have got off lightly because he's 17 I think over 18 would have been different . But what 17 yr old would be interested in a 12 year old kid ?? Bet he reoffends in the future

AskBasil · 01/05/2014 17:14

Yes quite, Needadvice.

I'm sure that if you're accused of rape, looking like an Obergruppenfuhrer is probably looked fairly kindly upon.

CaptChaos · 01/05/2014 17:23

I'm guessing he has offended in the past.

People don't tend to go from completely normal to rapist in a single bound.

lemonmuffin1 · 01/05/2014 18:08

what does it matter what he looks like, AskBasil?
