why would you be happy about this? Its clear The Sun has hacked many many people now, the billions they've paid out indicate that to be true.

Harrys case was thrown out because it was too late.

"I am satisfied that there is no reasonable prospect of the Duke proving at trial that he did not know and could not with reasonable diligence have discovered facts that would show that he had a worthwhile claim for voicemail interception in relation to each of the News of the World and The Sun"

It is to me, a real miscarriage of justice with phone hacking claims in particular that the timeframe exists, and that apparently famous people should do their own due diligence to make sure nobody in the press is illegally obtaining info.

Win or lose I support all of the claimants.

*The Duke of Sussex’s claim over allegations of unlawful information gathering against the publisher of the Sun will go ahead to a trial, after a high court ruling.
Harry, 38, alleges he was targeted by journalists and private investigators working for News Group Newspapers (NGN), publisher of the Sun and the now-defunct News Of The World, and has launched a claim for damages.

At a hearing in April, NGN asked Mr Justice Fancourt to throw out the duke’s case, arguing it was brought too late because he should have known sooner he had a potential claim.
In a ruling on Thursday, the judge concluded that Harry could not bring his claim relating to phone hacking, but that his claim over other allegations – including use of private investigators – should go ahead to a trial, which is due to take place in January next year.*

I was really hoping that this case would succeed. The Sun are monsters. Is this the case that people like Hugh Grant are involved in, or is it a separate one?
The whole phone hacking thing is a massive scandal that seems to have been largely forgotten and the tabloids are carrying on as usual.

I think these are the main points but @serenster may be around to add input

  1. Phone hacking ruled out of time as the 'secret agreement' that DoS claimed he was relying on and he wanted to amend his case to include was deemed not to have reached credible threshold, so case not amendable and consequently date of 'clock ticking' meant now out of time.
  2. Able to pursue other possible illegal activities including blagging etc to trial next year but judgement not yet delivered as to whether these are in time but it is not sufficiently clear that this element of the claim was issued too late so that element of the NGN claim (to have summarily struck out is denied)

The secret agreement claim was a load of crap, whatever that agreement was, Harry was aware of it and he used it to smear his own brother and the royal family once again. Thank goodness that part was thrown out.

Not really siprised at the split judgement.
Harry clearly was aware of the accusations of phone hacking well before the time limit.
His other part of the claim is another story.
Hope he gets the outcome he's seeking but think he's on a sticky wicket.
He's trying (quite justified) to try and shine a light on the shoddy practices of the British media.
Wether he succeeds has to be dependant on the law, not on which side you might take

That’s very bad news, much if his testimony was focused on phone hacking. In fact the majority, which means the case is going to be very very difficult to win now with a huge reduction in the issues he can raise. It’s pretty much game over.

No, sorry. Elton John, Hugh Grant and Liz Hurley lawsuit are against the Daily Mail but Hugh Grant is also suing the Sun. I don't know if it's the same case or a separate one.

Thanks for linking the full judgement, myrtleWilson; no legal expertise here (we really need Serenster) but I suppose this was fairly well foreseen, especially as the suggestion Harry couldn't have found out about the hacking until recently was clearly ridiculous

Happily there are other claimants who'll hopefully be able to give the Scum the hiding they richly deserve, and of course there's the illegal information gathering case to come - though whether he'll will be able to make a better fist of that remains to be seen

I'm wondering what happens about costs though; will this put Harry on the hook for what's been spent on the phone hacking thing, or will it have to wait until all the claims have been heard?
