Surely Sally’s costs would be paid by Duncan if he lost?

BettyBooJustDoinTheDoo · 18/01/2019 23:42

Sally did say in tonight’s episode that she had spoken to Paula and had set up a payment plan. Is that right though if your proven Innocent of a crime you still have to pay your own legal expenses? So on top of losing your liberty, your home, your job you still have to finance your own legal fees? Crikey.

KlutzyDraconequus · 18/01/2019 23:52

In a civil case it's often that the loser pays costs. Sally and Duncan were codefendants in a criminal case.

In criminal cases your solicitor does work on your behalf. Writing letters, gathering evidence, devising defence strategies etc etc.

These costs have to be paid whether you win or lose. If you end up in prison, you still have costs to pay.

KlutzyDraconequus · 18/01/2019 23:58

I should add..

You can claim legal aid if you can't afford to pay your defence costs. But even if they don't thy into cover all costs.
There was a time, way back when, when the Crown would cover your costs if found inocent of the charges, but.. good old Con/Lib government stopped that.

So unless it's been changed recently, if you don't qualify for legal aid, being arrested, take to court and found innocent could land you in £100,000+ debt.

I think there was a case, Nigel Evans, and I think he was acquitted and still had a £130k legal fee bill.

BettyBooJustDoinTheDoo · 19/01/2019 00:29

Thanks for the explanation Klutzy im really shocked, I had no idea that to prove your innocence and also to be proved you are actually innocent could cost you absolutely everything.

anxious62 · 19/01/2019 06:15

With it being yet another teen pregnancy story I wonder if they might do it differently. If it may be turn out to have been rape?

x2boys · 19/01/2019 08:26

Would Sally not get legal.aid?.without going into details a few years ago my dh was charged with a crime he got full.legal aid up to the value of £30,000 which paid for his solicitor and Barrister he is on a lowish wage though .

Clawdy · 19/01/2019 08:43

It would be a very different storyline if Amy has a termination, which would be far more likely as she is fourteen. But they will probably just repeat the Faye storyline. Tracy as a grandma....hmm!

Optimist1 · 19/01/2019 09:00

Please, please let the pregnancy test kit not be Amy's! As PPs have said, that storyline has been done to death. Perhaps it's Tracey's, discarded in the bin as is the way in soaps, and Amy found it - hence her anxious expression?

eddiemairswife · 19/01/2019 10:14

Perhaps the teenage pregnancies are to keep the character in the show, as otherwise they would have ambitions and, horror of horrors, have to leave the street to go to university.

SgtFredColon · 19/01/2019 10:35

Ha eddie wasn’t that why Todd didn’t go to Oxford? Cos Sarah got pregnant? And Daniel come to think of it.

Honeyroar · 19/01/2019 10:39

Thanks Klutzy. That's shocking! Who pays for mass murderer's big trials? When they are imprisoned for life and can't earn money then? Could Sally not sue Duncan?

qazxc · 19/01/2019 10:40

I agree that the teenage story has been done to death and lazy writing. There are so many more issues that they could run as a story line, especially as the Amy actress seems to be quite good.

x2boys · 19/01/2019 11:07

Assuming they were a low/no earner they would be entitled to legal and d I imagine Honey everybody's entitled to a fair trial.

KlutzyDraconequus · 19/01/2019 11:07

Who pays for mass murderer's big trials?

Here's an example, one of Harold Shipman's solicitors got over £1m in legal aid money.
Solicitors will often do big cases for less as it gets their name out there too and in some cases makes them well known. Like the woman that's working in the Steven Avery case right now, Kathleen Zellner, she asks for donations towards Avery's costs but she'll make a ton with books and promotional tours etc etc. Especially if she gets him out. His old defence lawyers do talks and book tours and that makes them a very good living.

But it's very complex. My top, don't murder anyone, not even if they cut in line in Tesco.

Legal aid*

KlutzyDraconequus · 19/01/2019 11:28

I don't want to go off topic with legal cost nonsense but..
The most recent I can give examlpe of is Steven Port. He was convicted of 4 murders a couple years ago, possibly connected to over 50 others. He got £130k in legal aid to fight his case. The families of his victims have had to crowdfund to try and get their legal team costs covered.

Whole system is screwed up.

x2boys · 19/01/2019 11:33

I don't want to go off topic either but what legal costs would the families have?.it would be them CPS prosecuting surely?

KlutzyDraconequus · 19/01/2019 11:48

I don't want to go off topic either but what legal costs would the families have?

Victims and their families need representation at inquests etc.
A solicitor is there to make sure the victims voice is heard and to translate the legal maze and terms into plain English.
Plus the families are pushing for investigations into the police and their role in catching Stephen Port. They believe the police didn't do their job and it cost people their lives. Last I heard, and I'll be googling in a minute, but the inquests should be this year...

(I googled.. and yes they are. Interesting to see findings)
