Hi all! Does anyone know when monthly payments will start after back pay? Recieved my letter today but can't seem to find any Info about when payments will start. Is it 4 weeks after back pay or a certain date of the month? Thanks

Am no legal expert, but a quick look, suggest that without settled or pre-settled status, you can not receive benefits.

Or use the NHS for free or go to school.

Also says pension from other countries do effect claims.

We do have settled status and we do claim benefits, attending schools here since 2015 and having NHS as we live in this country form almost 10 years. My youngest one who's special needs is 9. He was just a bit unlucky to loose his dad at young age and the pension is a support what's now affecting his eligibility to DLA. I do understand law is law and have tried to be simply honest when filling out the form. Now I need to focus on how to sort this all out not to prove them wrong or right.

In that case, it looks like its the pension element.

Strange when, DLA, isnt means tested πŸ€·πŸ»β€β™‚οΈ

But there are complicated rules for when child gets a benefit from outside uk according to citizens advice website

Lindsey89 · 24/06/2024 13:57

Finally got through scan date 5/3 she was quite rude said no update I asked how long are new claims taking she said give them upto a week you should hear something before then I don't know how to. Take that has the decision been made and she can't tell. Me or is it a reason grt me off the phone.. The whole reason I waited it out nearly 16 weeks before I rang the wait goes on

It's OK. None of us are British citizens. Moved here almost 10 years ago. My late husband worked here since we moved till he got terminal ill (3,5 year) My son gets Survivor's pension from the country he was born.. he's eligible for it till age of 18 even if he lives abroad. It's like child maintenance from government if one of the parents passes away before children turns 18. Good thing I have saved all the paperwork from my late husband starting with p60, hospital letters, bereavement letters. At this point I will give all the information what I have to them to look again to his claim.. if that pension still is a problem I will cancel it as I just need sort everything out for my son to get all the support he deserves here where he lives and will stay for good.

I have sent you a private message but not too successful.
PLEASE speak to Citizens Advice and ask if they have a person who deals with benefit queries, this is a complex query and you probably need specialist advice.
I would advise not to cancel the pension as the DWP are aware of this, quite rightly as you told them, hence the decision and they have confirmed the details with the pension provider, that's probably why it has taken so long. You can do an MR but you will need to do this correctly as they have made their decision quite clear, hence why you need to seek advice.

I will just sent out the letter and put on everything I think they should know to reconsider the decision.. if they still think it's a big issue will ask my next steps to do towards my homelands pension..

I rang and she said my claim is with a case manager (does anyone know the difference between it being with a decision maker and a case manager?) and I should hear this week. She's also put a note on for them to text me when a decision has been made, which I asked because from reading on here it seems very hit and miss as to whether you get a text or not.

I have found she was the most helpful person I have spoken to. Some have given me no information other than "we received it on 12/04 so you should hear by 20 weeks" which is so unhelpful.

I wouldn't cancel pension as it could go against you more and end up without that aswell.. go to citizens advice they will tell you if you be able to overturn it or what is best to do now

Mummyof6love · 24/06/2024 13:27

Oh wow! Ah, hun. That sucks. Was it a nice lady you spoke to? Maybe worth another call and try someone else? Not many scan dates from ours waiting, I don’t think.

She wasn't rude but she seemed like she just wanted me off the phone tbh. Didn't offer any information just said it could be another week..
I might try ringing again and asking if another week waiting is right as I thought dm make decisions within 2 weeks ? I might be wrong xx

OK... I guess I'm just so fed up with this all I'm now freaking out and want everything to be sorted as soon as possible πŸ™ƒ

Heartyguide gives you great advice.

The length of time, has been a disgrace but do you think you should have been awarded and why ?

This what you will need to say in the MR, because they are clear in how they have got to the decision
