Yeah i was told this on Thursday last week, scan date 5/3.

Have you called them back since or just waiting it out?

All I said to her was that I was at about 15 weeks now since SD and she said she would put it to first. I didn't ask or claim any financial hardship. I was fully expecting her to just say wait it out and to call back if I haven't heard by end of July.

I know my eldest daughters claim I called just before 16 weeks and they said I should have had a decision by then so they made that priority and it was awarded the next day, so hopefully not much longer 🀞

Just got the letter with decision and I guess I need Citizens advice. Will attach pictures with reason why he's not eligible for care and let me know your thoughts. It's a bit sad he's not been treated like a child.

It's not always for financial hardship when made a priority, or at least this was not the case for our claim, my son was deregistered from mainstream school because they could no longer cater for his needs, so now im full time caregiver they prioritised the claim!

I think it sounds like your on the same as me, it’s called priority first ( more of an emergency for a decision ), mine was put on there on Thursday too after it being put on the wrong priority the week before apparently, so we should hear about the same time, he told me that I should know the decision by Friday if not before. I think they put it as financial hardship just because there is more urgency for us to start receiving Dla toward the care of our child for many different reasons.

Going on others that was on priority first our decision should be made at some point tomorrow, I think I’m going to wait til Friday to call like the call handler said because if it is made tomorrow then backpay would be in Friday anyway so either way I would need to call for rates or to find out decision

@Matilde08 can you please confirm what it is you disagree with?
You've said you claim a benefit from a different country due to the child's father passing and that is what the letter states which is why the care cannot be claimed x

So if this what they are saying it might be a long shot but could your spouse maybe claim for your DS, is your partner originally from England if you don’t mind me asking, if so surely he is entitled to claim this benefit ? Xx

Do you not have national insurance contributions or have you worked in the past? I think if you prove that you could be entitled. It sounds more complex as it’s to do with EU which the UK is not a part of anymore. You might benefit from consulting a solicitor for advice.

They clearly saying some people may be able to claim DLA Care from the UK if they are partner , spouse our dependent (what is my son to my late husband and me obviously) have paid enough NI contribution. He's dad who passed away here in England was working here from 2015-2019 so he paid some contribution. Same like me I got Bereavement benefit from UK as he passed away here. Also they say if someone (he's dependent on) are in receipt of State Pension and I am and I can prove that.
They have made there decision like he's and adult not under 16 child.

There's section to write them within the month of letter dated if I think decision is wrong and explain all this?

If you ask me about my husband now and his step dad ..yes he's British nationality and in full time employment. But is he's even able to do that?

I Just Rang For My Daughters MR, (20/03) It's Not Currently With A Case Manager, He Said I Should Know By Next Wednesday Though (15 Weeks Is Up) If It's Late To Ring Them And They Will Tell Me Why πŸ€―πŸ€¦πŸ»β€β™€οΈ

It's OK. None of us are British citizens. Moved here almost 10 years ago. My late husband worked here since we moved till he got terminal ill (3,5 year) My son gets Survivor's pension from the country he was born.. he's eligible for it till age of 18 even if he lives abroad. It's like child maintenance from government if one of the parents passes away before children turns 18. Good thing I have saved all the paperwork from my late husband starting with p60, hospital letters, bereavement letters. At this point I will give all the information what I have to them to look again to his claim.. if that pension still is a problem I will cancel it as I just need sort everything out for my son to get all the support he deserves here where he lives and will stay for good.

Oh wow! Ah, hun. That sucks. Was it a nice lady you spoke to? Maybe worth another call and try someone else? Not many scan dates from ours waiting, I don’t think.

Am no legal expert, but a quick look, suggest that without settled or pre-settled status, you can not receive benefits.

Or use the NHS for free or go to school.

Also says pension from other countries do effect claims.
