Yes! I'll be thinking of you. Remember that you're not asking for the moon on a stick. You're simply asking for the only rational course of action in your DD's circumstances, in the light of the provisions in the SENCoP.

Currently sat at the train station waiting for my train. Think it only takes about 30 minutes so going to be really early but know where the coffee shops are! Was watching tv at 5.30am and was a programme on about children with disabilities and the last story was dyslexia so i take it it could be a sign. Went and gave my daughter a kiss before i left - she was fast asleep.

She's probably sat reading the file for the first time since the final evidence deadline! I got off first and she has a bad back so walked very quickly and now hiding in th city centre and had my breakfast is pret a manager Smile

This is the bit in the LA case statement that really gets me, the just say again and again that there is no evidence she needs an assessment and needs can be met at school action plus. Then they say

'whilst a statutory assessment at this stage may provide new information, such an assessment will be unlikely to lead to a statement of special educational needs'

So even then if they do ever assess they've already decided its a NIL or no statement , how can they say that when they do not know what her needs are? Just shows how completely arrogant they are. Today I predict the sen officer is just going to sit there and say she has no needs at all and teacher saying what marvellous progress she is making.

Now waiting for my dh to get her from the school run. Fingers crossed the traffic is kind to him

In and out in 2 hours - teacher came and gave most of the evidence. Panel said it was a well set out bundle and then just asked questions. Teacher gushed about the progress that she's made since Xmas. Now school agreed to call in the teaching service to see her which previously they had refused point blank to do and doubt they will still do that. I did get in that the teacher had made her re do tests and the test she was given was for a younger child which the teacher agreed. Teacher didn't agree specialist teaching helped her but that went onto to say he herself had it as a child for 6 years and the improvement it made. Tribunal made reference about specialist teaching being 'rolls Royce ' provision. I didn't specifically make reference but said that code said if a child has significant difficulty SA should be done and argued every single report stated she had significant needs. Panel got the LA to agree that her needs more than just dyslexia given all the reports and that it was clear in reality that all of her needs are yet to be identified. But the teacher gushed and made out my daughter only kid in the school and she's sharing another kids 1:1 - this 1:1 seems to give 1:1 to every child in the class so quite how much extra help she gets in reality - who knows! Have no idea at all how it's gone, cant read the panel as usual, can't believe it's over so quickly, la closing speech just said her needs can be met at SA and therefore she doesn't need an assessment. And now the wait begins......

Think it is true what you have all said, that no matter what happens hopefully she will get more provision but we will wait and see. My gut instinct tells me the teacher said what she felt the panel wanted to hear. She was warned. Y the panel her evidence had to be neutral for both sides and when she started talking about her LA sen policy the panel stopped her in her tracks and said they were no interested I. Policy, it was the code that they were interested in.

Interestingly the LA officer at no point made any reference at all to the code of practice.

Was going to say sometimes when panel say things positive to other case it's because going out of way to be balanced so LA can't say views not heard. We felt panel gave LA a lot of help but we still won every point.
Well done though. Hope you have nice afternoon planned.
