I am a very regular poster but this blog outs me completely so I am posting the link under a namechange - I am sure many can hazard a guess.

My blog is under construction here but I would welcome your thoughts. I am happy to add a parents' stories page if people would like to share anonymised stories.

I have other lawyers who are in the process of adding tips/info to it and several other firms confirming the free initial consultation.

I hope it will be of use to parents starting out - that is its only purpose!!

Oh and a big thank you for a poster (can't remember who ) who suggested the name ages ago.

Something that?s puzzled my non-legal layman?s eyes for ages? When does ?something? become case law? Is it a decision that took place during the First Tier process? Or is it when it goes on up higher ie when there?s been an appeal by either party? How does it become ?case law??

Roiselou - case law comes from courts which can bind other courts by the principle of stare decisis (precedent).

So it depends on the court. The FTT cannot bind but the UTT can. They are bound by the judgments of higher courts - Court of Appeal etc.

Basically, courts you can appeal to tend to be courts of record which can appeal.

Yes he is - I've read other of his documents but not come across the one that you had linked to. Because it's only 6 months old, there is some extremely useful recent case law he has on it
