the Bernera cafe/dog/legal aid saga - wtf?

American woman living in Bernera is suing the local community run cafe because it would not admit her "emotional support" dog. She is being supported by the Ethnic Minorities Law Centre because Americans are ethnic minorities, and is being funded by Legal Aid. She wants £10k, which would shut them down.

I mean. What the actual fuck. Move to a tiny island with 250 people on it, claim you're being ostracised and harrassed and try to solve that by suing a charity? That'll sort it. And LEGAL FUCKING AID???

I don't like dogs. Especially agressive ones. Why should I have to tolerate them. Proper assistance dogs are well behaved.

Possible Frenchie cross. Neurotic. A very experienced dog friend looked after him for a few days, confidently expecting to hand him back better behaved.

Our dog was a "Cleaner": He ate everything foodwise that wasn't silver foil (I do mean everything)! So should he have been admitted to all establishments or should we have sued so he could clean up?

Does she actually describe it as an "emotional support dog" rather than as an "assistance dog"? I'm sure that in the UK, culturally speaking (and perhaps legally speaking??) the former doesn't automatically qualify as the latter - and it is only the latter that service providers might have to allow in, to avoid disability discrimination??

Also, is her ESD actually an Irish Wolfhound (or even two Irish Wolfhounds) as the picture implies? I'm not sure you need that much dog for support - unless your emotions are especially heavy.

I have donated because my grandfather was the GP in this area in the late 1970s and I have lots of happy memories from my holidays as a child.

Yeah. I used to have a CF friend that had a really badly behaved dog that the neighbours complained to council about. The ‘solve’ was to buy a jacket off Amazon that stated ‘Assistance dog’ and then she took it everywhere (so it couldn’t kick up merry hell when no one was home), and then she kicked up merry hell if challenged due to her rights. Absolutely nothing wrong with her, apart from severe CF’ery, and everything wrong with the dog. Absolutely anyone can have an ‘assistance dog’.

Then those massive dogs won’t be “emotional support dog” for an undisclosed gynae condition. For goodness sakes. Way to make oneself unwelcome on a small island.

We need a register of legitimate assistance dogs for blind and deaf only, and outlaw anyone using any sort of guise to pass their dog off as an ‘assistance’ dog for any other reason. This sort of nonsense has gone on too long. See also those ridiculous sunflower lanyards.

I agree about the assistance dogs but I think the sunflower lanyards are fine. They don’t even give any special rights to anyone AFAIK?

“Looking crazy” is subjective. Neither of the women on the BBC article “look crazy” to me, or as if they are acting crazy. What you mean is “dressed differently” which is a whole different subjective.

Bored yes I am disabled not that is relevant to 1979. I donated to the Bernara cafe so they have money to support the claim against them? Or have I misunderstood the reason why they are raising money? Sorry if I have. I actually have a brain injury so can misinterpret things.

Lawyers errors all the time. That doesn’t mean cases have no merit. But, if it were a simple admin error, it wouldn’t have cost the Community Association £££ in fees to sort it out. A single legal letter in response saying they have no association with the Cafe would suffice. The fact it took so much money to sort out was likely the lack of proper legal documentation, very common with these sorts of organisations who just pick a set of legal looking documents off the internet and set up a community group and think it’s ok. If there was absolutely no link between the two, why did they continue to fund the legal fees in the case until they ran out of money?

To suggest a Law Centre, established for 35 years, handling hundreds of cases each year, are so slap dash they did a quick google search and raised a claim with the wrong organisation is ridiculous. More so because the suggestion is based on media reports saying “they sued the wrong people” and nothing more.

I wouldn't be so sure.
The good law project make these kinds of silly mistakes on the regular.
There was a case recently where a law firm relied on an AI hallucinated section of law to make an application and when challenged doubled down with more AI hallucinated argument.
It happens more than you might think.
