the Bernera cafe/dog/legal aid saga - wtf?

American woman living in Bernera is suing the local community run cafe because it would not admit her "emotional support" dog. She is being supported by the Ethnic Minorities Law Centre because Americans are ethnic minorities, and is being funded by Legal Aid. She wants £10k, which would shut them down.

I mean. What the actual fuck. Move to a tiny island with 250 people on it, claim you're being ostracised and harrassed and try to solve that by suing a charity? That'll sort it. And LEGAL FUCKING AID???

I'd also missed that they were trans (I really should read things properly!). That could be an interesting 'proving your disability' case to keep an eye on then.

Really?!? Had totally missed that too but hadn’t seen a photo.

For a supposedly small minority these men pretending to be woman cause a whole lot of trouble.

I unfortunately think he’s going to win this case as it doesn’t seem like there’s any training or registration needed to claim a dog is an assistance dog in Scotland.

Dogs that provide a proper service are service dogs. These emotional support dogs are a joke. Strictly speaking all dogs could be considered “emotional support” if they are a pet.

I don’t like dogs in cafe, it’s affecting my emotions if she brings her dog in the cafe how about that then?

Honestly she’s disgusting. It’s like me going to a cafe that says dog welcome and insisting everyone with dogs should get out, because a pet-free zone is necessary for my mental health.

And shame on the EMLC, this woman is not an ethnic minority.

In my professional life I work with a LOT of these people, usually Americans, who have clicked lots of "hints" on sites like Ancestry and think this is proof they are descended from all sorts of notable people. All of us who have Scottish roots going back several generations probably have royalty somewhere in our tree, it's just a numbers game. Proving it is an entirely different matter.

Americans also often don't take kindly to being told that having a Scottish ancestor who left on a boat in 1888 does not make you Scottish. There is quite a nasty undercurrent to this thinking - Scottish is about "blood" and those people whose parents/grandparents immigrated to Scotland from India/Africa/Caribbean are therefore not Scottish despite being born here. Canadians, in my experience, haver more nuance/understanding about these matters!

You are spot on about the Scottish heritage thing. They would look at my best friend a brown girl born in Glasgow as “not Scottish” but they are. There’s a reason a lot of MAGA are fond of Scotland/Britain.

Bur I don’t think businesses are required by law to accept “emotional assistance dogs”

I also read that this bully initially tried to sue the wrong charity that had nothing to do with the cafe and which incurred significant costs having to show that.

This would be funny if it wasn't so bloody tragic, that one entitled bully with legal aid ffs can threaten and harm two community organisations that have done so much good.

Surely there needs to be some consideration of if something is in the public interest before they fund it via legal aid?

I can only hope they are allowing her to take this through the courts so they can make a decision against her that can act as a precedent to stop it from happening again. Because the law seems to be a bit unclear about this “emotional assistance support dogs” crap.

Legal aid is, in my opinion, overly restricted in England & Wales, but then you see a case like this and think "well at least you'd never get funding for that here"
