My husband and son are going to declare themselves female.

His judgement is based on the census. My understanding is last week''s judgement makes it clear sex in the ES refers to biological sex and the Scottish Government doesn't have authority to change the meaning there.

@mnhq please can you keep this thread on Scotsnet so we can let people know who haven't heard or understood the impact of this?

I'm going to mark everyone in this house as female in the hope that services for women will have to be expanded due to the huge sex imbalance in Scottish society.

That part of the Scottish census will now be meaningless.

Thankfully a day or two later a higher court has also published this judgment www.judiciary.scot/home/sentences-judgments/judgments/2022/02/18/for-women-scotland-v-the-la-the-scottish-ministers which clearly defines woman and man.

This Judgment will obviously form part of the appeal against the census ruling as it has been made by a higher court.

You can be fined if you give false information on the census. How will that definition work now ? Watch out @Rodedooda :-)

I think you are a bit behind the times... The appeal was lost and sex in the census is down to how you feel like identifying on the day.

This thread absolutely should stay in Scotsnet - it's hugely relevant, and important that as many people as possible hear about it. As a previous poster said, it's such an own goal - surely it's really important to have accurate biological information for the planning of health services? Census could still have asked about gender identity as well.

As far as I know it still does.

This census is going to really fuck things up for trans people.

Some trans people will answer the sex question as their birth sex, and others how they identify, depending on their point of view.

The gender identity question is voluntary so some will answer and some won't.

The net result will be that it will not be possible to establish how many trans people there are in Scotland and whether they are transmen or transwomen. With such a small population this is going to be a massive problem with planning things like trans healthcare.

How can there be legal repercussions for stating your sex as you feel it to be on the day you complete the form? After all, nobody can tell me anymore that I'm not male, or not female, how could that possibly be proven?

Why would your son and husband declare themselves female if they are not (I'm assuming they are not trans)? What a very stupid thing to do.

It's none of your business how OP's family members identify. It's certainly not OK to assume someone is lying about their trans status.

It will not be possible to give 'false' information wrt sex, as anyone can answer it in any way they please.

For Women Scotland are suggesting ordering a paper copy of the census, they are going to consider how women can protest lawfully via the form.

I'm watching that carefully, I want to protest but don't want to open my family up to any sort of legal consequences, although frankly we've been ready for something like this ever since I started getting more vocal about the entire shitshow.
