Just caught up with the new thread, P15 already. The legal advice + the FOI regarding ‘woman H’ on Wings is utterly damning. This has never been about standing up for women, we have been used as pawns in a political game.

I’m genuinely disgusted by the antics of the SNP in government, genuinely. If she walks out of this unscathed there is no justice.

quite terrifying and authoritarian. Yes, I remember you saying in your opener to the original thread that Scotland had become a corrupt nation and our politicians are 'like Putin'. It's a shame that, as someone who doesn't live here, you see Scotland that way. You're entitled to your opinion, of course, and clearly the vast majority of people on this thread agree that it's as bad as that - and worse. However, many don't and for all its very many faults I like living here in Scotland and I'm really proud of our FM, despite disagreeing with her on a number of issues. I've lived in England in the past and I liked that too, but I do remember quite a bit of corruption going on at Westminster, as I think you'll agree, there still is.

as to the astroturfing reference, i'd only just found out what it was - for all the indignation here over others being unquestioning, blindly accepting/cultlike etc there's a very low tolerance for any disagreement - I'm sure you'll have seen, the small amount of 'eh hang on a minute,' posts I've made are miniscule in comparison to the avalanche of people all agreeing with each other. But some can't even seem to tolerate that. I seemed to be being accused of orchestrating some kind of campaign or something. When someone explained what astroturfing is I recognised it as something I've noticed happening from time to time on mumsnet. You'll maybe start noticing it too - health and beauty is the worst, not that I go in there much Blush.

I took it is "ignoring all the other things they're arguing about the bloody procedure being pish/possibly not valud being retrospective, and all that jazz - Alex Salmond had a legitimate expectation that you numpties would at least follow your own pish"

Yes - I agree.

I have to say its an amazing argument (not a compliment either) to say that you make up a policy, apply it retrospectively where there were criminal charges possible is stunning. Retrospective policy making has a generally high litigation risk anyway because from a public law point of view, then you are supposed to know what applied to you when you do it. This applies as a general legal principle, otherwise what could stop a government abusing its power and individuals by changing things when they liked?

If you want to make retrospective law or policy in the UK you need a very good reason. And you will have to get it through a lot of lawyers to have Westminster agree.

Scotland is apparently very different - though its lawyers appear to know that its a big problem.

He could hardly string a few sentences together but he spoke for hours on nothing

oh dear, how many fronts are the fires being fought on now?

Woman H didn’t appear in any of the logs or diaries that are kept of visitors to Bute House. The only witness who vaguely suggested she might have been there was a celebrity who the defence wasn’t allowed to cross-examine and who’d given a video-recorded description of a woman who was nothing like her – different hair colour, different clothing and forgetting the detail that she had her arm in a sling, which one might imagine would have been quite memorable in someone trying to eat dinner.

You just can't make this up can you?

Yeah okay - you show me where they tried to make a retrospective policy in an obvious breach of public law principles and apply it to a former colleague where there was a criminal proceeding already in prospect.

What is to stop this happening to other people in Scotland if you can just change things to suit? Or is it just for Alex Salmond? The mind boggles.

Yes and you would be amazed to know how many people think your example would be acceptable because it would it would never apply to them apparently and that would be okay - pretty much a total negation of the rule of law however, and certainly unlawful. You'd be at the mercy of politicians, and it would not be compliant with the ECHR.

Is anyone else just really fucking angry?

  1. She used her power to corrupt and has made Scotland a laughing stock
  1. She's a female fucking leader, one who could really influence young women into breaking the glass ceiling and she's totally ruined it
  1. We are all locked up, loosing income and no freedom while she swans about rolling her eyes and taking swipes at WM

Make no mistake they are rotten as well but the hypocrisy is stunning.
