Is this rape/sexual abuse?

Please picture the scene and give your opinion...

a woman is having sex with her husband. After a while, she asks him to stop as she just cannot get in the mood. Instead of doing as she asks, he carries on alhough "speeds things up" so that he still gets what he wants out of it.

5 minutes or so after she asked him to stop, he does.

Is this still classed as rape/abuse?

Judges do decide sentences though. And the fact is that rapists are being given horrifyingly lenient sentences by judges (probably not the majority, but one is too many) who hold old-fashioned, sexist ideas about provocation, consent etc.

And AFAIK judges can instruct juries on how to find the defendent and as such they can and do influence conviction rates.

I find it unbelievable that people here believe that a woman can say 'stop' several times and try to push a man off her, yet she is not being raped.

I shan't join the debate about whether judges are doddery or not, but i do wish to state that i did Jury service on a rape case at crown court.

What the woman went through made sure i would never ever dream of pressing charges for rape unless he was caught on camera dragging me into bushes and he signed a confession.

Whilst the law now states that a woman's sexual history cannot be brought inot court it does not stop defending council making the poor woman sound like a slut who came on to him and then became bitter and cried rape.

Rape is a very serious charge and i have every sympathy for any man that has ever been falsly accused, but the judicial system does make it incredibly hard for a woman to have the confidence to take her case to court.
