Hi, I dont really know where to start with this but im getting really worried about it now and its probably because im 34 weeks pregnant and everything is getting to me

My boyfriend has 3 years left on his visa and it runs out in 2029, when we first got together I didnt really think about it because it seemed so far away but now we have a baby on the way im starting to think what actually happens if he cant stay

He is here legally before anyone asks, im not worried about him being here now its more what happens when it expires and if he doesnt get residency or whatever he needs next

I keep thinking surely having a baby here must count for something? Or does it not make any difference because the baby is his anyway

I know 2029 sounds ages away but it doesnt to me now, especially when you have a baby and your whole life is planned around them. I dont want to be sat here in a few years with a child and having to think about him leaving

Maybe im being stupid and overthinking it but has anyone actually been in this situation

I just want to know if the baby gives him any sort of rights or if im completly wrong about that

Sorry if this is obvious I just cant stop thinking about it now

There are a number of options. You shouldn't be panicking on Mumsnet about it, he needs to get advice from an immigration lawyer so he knows what his options are. You might not want to get married now and that's sensible but marriage is the best way to legally tie him to you as a British citizen.

Does he want to stay long term? Do you both want to be together long term? A quick google suggests he can apply for indefinite leave to remain after 5 years as refuge or can get a visa based on relationship with you & having a British child. No idea if I understood that correctly, you’d need to consult an immigration lawyer, but seems like there will be options. Bigger red flag is that you’re having a kid together but you don’t know important details about his immigration status and he apparently hasn’t brought up future plans to ensure he can support his family long term.

Get the full info from him, including paperwork to prove it. Talk to a lawyer to be sure what the options are and how long it takes to process each. Likely you can wait at least 12-18 months before needing to take any action, that gives long enough to both figure out if you want to be together and if it’s worth the effort or not.

If you’re unsure about him and weren’t actively planning a future together already then seriously think about how single parenthood would look for you. You can still give the relationship your best shot but be realistic about the situation. Even more so than usual, don’t give up your own financial security.

Op, does he want to stay and be in a long term relationship with you? Do you live together, you fell pregnant very quickly if you’ve only been together a year and already 6 months pregnant,

do you want to be in a long term relationship with him? This is key, as I doubt he’d want to go back to Syria, so it’s more what you want.

Yeah but compounding it to marry him so he can stay when she’s only been with him a year would not be advisable

The baby is a permanent fucking tie. A marriage isn’t.

its far better FOR THE CHILD to have their dad in their life than not.

getting married, being an involved and hands on dad MUST count for something in the eyes of immigration officials.

@TreadlngWater GET PROPER ADVICE! You have time to demonstrate that he should stay to be a dad to his child, but “oh I don’t want to just get married for a visa” when you’re about to fucking give birth to a child is just nonsensical

start thinking about the child’s best interests here.

Unplanned huh? And you’ve only been together a year or so. And he may not get to stay. Jeezo, this may not work out even if he gets to stay op. First of all you better consider planning to be a single parent as well as looking into his visa options. Best to be prepared. Check out Home Office for visa immigration rules, and consult an immigration lawyer if you can (they cost).

Towards the end of the 5 years he needs to apply for ILR - indefinite leave to remain. This is based solely on the assessed risk to him if he were to return to Syria and not on his family situation. Neither having a child in the UK nor marrying change that. But when I looked it up it said that most Syrian applications for leave to remain are at present being granted because the danger to refugees is recognised, so unless the political situation changes between now and 2029, then it looks hopeful.

OP, you need an immigration lawyer, or rather, your partner does. Immigration law is incredibly complicated and changes frequently. Some of the posts on here contain simply incorrect information. I once saw a visa refusal for someone who, despite having a British wife and children, was refused because the Home Office considered their relationships could be conducted via technology such as FaceTime. I wish I was joking.

Your partner likely already has or had an immigration lawyer or he wouldn’t have been granted refugee status and granted a 5 year refugee visa. He just needs to go back to them and ask what the next steps are, ahead of his visa running out.

The baby will form the basis of a right to stay in the uk bid. If the next government is tory or reform expect that it will get a lot harder to use a child as a reason to stay.

Has he actually asked you to marry him? Because being honest here of you are with an arab muslim man he will basically insist on marriage unless he has very little respect for you. I’m not saying this to be a bitch but children outside of wedlock is soo utterly shunned that even liberal people baulk at the idea.

My DP is from india and just became a citizen. We did the entrepreneurship visa. We also know those who got the spousal visa. There are different visa options depending on what he does for work etc. You may have to seriously consider whether marriage and having him here are the priority over not getting married.

I think there is something you can do with a child’s passport, something like get a solicitor to register with the passport office that a new passport is only to be issued via you and the solicitor, NOT by someone else claiming the passport is lost so needs reissuing. I have a vague recollection of reading it here.

OP, you don’t really know anything about this guy. You have one chance to keep your baby safe, don’t worry about other people getting offended by your actions, just make sure your baby is supported legally.

A good honest father will understand where you are coming from and it won’t be an issue ☺️.
