Hi, I dont really know where to start with this but im getting really worried about it now and its probably because im 34 weeks pregnant and everything is getting to me

My boyfriend has 3 years left on his visa and it runs out in 2029, when we first got together I didnt really think about it because it seemed so far away but now we have a baby on the way im starting to think what actually happens if he cant stay

He is here legally before anyone asks, im not worried about him being here now its more what happens when it expires and if he doesnt get residency or whatever he needs next

I keep thinking surely having a baby here must count for something? Or does it not make any difference because the baby is his anyway

I know 2029 sounds ages away but it doesnt to me now, especially when you have a baby and your whole life is planned around them. I dont want to be sat here in a few years with a child and having to think about him leaving

Maybe im being stupid and overthinking it but has anyone actually been in this situation

I just want to know if the baby gives him any sort of rights or if im completly wrong about that

Sorry if this is obvious I just cant stop thinking about it now

This is what bringing back control of Brexit means in practice. The preference is that you would leave the UK to go to his country, and weren’t you very foolish to get pregnant by ‘Forrin’.

does he work?

What type of visa is he currently on? - he will probably have a few options depending on his circumstances at the time, but if all else fails he could apply under family and private life on the basis he has a British citizen.

What country are you in, what type of VISA is he on, what are the requirements to extend it? Just make sure you meet those requirements and apply in plenty of time. Get a solicitor to help with the application if you need to. Make sure the application easily fulfills the criteria, for example, if he needs an English language test do it well in advance so you're not rushing near the end. Don't earn what they need, earn a bit or a lot above the minimum.

What country is he from? What visa is he on? Does he work? I’d imagine he’s going to have an easier time of it depending very much on those things… Who the government is in 2029 could also make a difference so best to get organised as soon as practical.

You need to speak to and pay for an immigration lawyer give all the specifics. And probably keep working so you can sponsor him ?
Would you move to his country?

I mean surely you’ll be married by then. Though tbf he should have seen to that before babies were on the cards. Mind you, maybe he doesn’t want to ask incase he thinks you’ll think he’s using you for a visa. But still…

Not that that covers every country though…some countries there’s restrictions like you need to have a certain amount of money in the bank or earn a certain amount etc…

He works full time and hes on a 5 year visa as a refugee from Syria

I dont really know all the proper terms for it tbh, I just know what hes told me and that its for 5 years and runs out in 2029

I didnt realise there were different options depending on everything, I thought once it runs out he would just have to apply for residency or whatever happens after that

I know 2029 is a while away but im just thinking about it more now because of the baby and I dont want to leave it until the last minute and find out theres a problem

@LifeBeginsToday I was thinking the same thing. As you're in a LTR, this might be worth looking into.

Go on gov uk and find out then speak to a refugee advice line for clarity or lawyer specialising in this area. Dont just ask on here ! find the relevant charity and ask in person .

He may work full time but is he on min wage or above.
I believe one of you needs to earn around £29000 for a spousal visa.
and I believe full time on min wage is not £29000.

If he has refugee status does he have access to a legal advisor for info on visas ?

So look at his visa
Go with him to an immigration lawyer
Find out properly
Dont give up your job

Surely you’ll be getting married anyway, seeing as you’re expecting a child together? That will open up the option of a spousal visa.

You can get married and apply for a spouse visa and then indefinite leave to remain

I completely get why you’re concerned but you have a lot to deal with right now and so I’d revisit it in 2027 which still gives you plenty of time to sort things out.

You need to both go and see an immigration lawyer and get expert advice asap. You're doing the right thing to be thinking about this now.

Maybe if you had more information you would feel less anxious.

You are about to have a child with this person and you have no idea of his immigration status. Come on now.

How long have you been together?

Posters are suggesting you get married but i definitely wouldn’t rush into that, especially as you have a couple more years until it runs out.

You can marry and sponsor him but you will need a minimum threshold salary for that, I don’t know the current level.

He may be able to apply in his own right for an indefinite leave to remain track visa if he has a wanted occupation or his homeland isn’t safe. There’s also other options but i would talk to a refugee charity who know the up to date law.

What is his job? I agree you need to know a lot more than you currently do, and I wouldn’t be marrying anyone without this information. I’d get separate advice for you re what happens to the baby if the father is married to you ie what rights does he have?

So you need legal advice, both with him and by yourself.

Weve been together just over a year, so not that long really

The pregnancy was unplanned tbh, obviously we are happy about the baby but it wasnt something we had planned for yet

A few people have said get married but I dont really want to just get married because of his visa, that feels like a massive thing to do for the wrong reason and we would both know why we were doing it

We have talked about marriage before but not like right now and especially not because im panicking about 2029 😂

I think because im pregnant im just looking at everything differently and worrying about what our life will look like in a few years

I dont want people thinking im trying to marry him to keep him here because thats not what this is about
