Archers All views on The Archers welcome here! New blood welcomed. We don't all agree on all points and most of us are posting tongue in cheek a lot of the time, so don't worry about revealing that you'd like Hannah to stay around, or other unusual views. Grin

Can Gavin really be so entitled to think his Dad - a builder - would finance a £20k wedding in Bali???

Although I employed a builder once who kept horses... so probably could have afforded it. But Philip isn't that kind of builder.

The only thing you can say in her defence for securing more land unbeknownst to them is that she has at least tried to contact them, seemingly numerous times a day.

Has anybody got a scooby what the legal position is? Pip can sulk at Phoebe all she wants but if she has signed up to some enforceable agreement then she needs to face up to it.
I don't think that Demara's legal department will be impressed with sulking as a business strategy.Hmm

Gavin said not. So, extravagant wedding that they expect guests to pay an arm and a leg to get to, not to mention a whole day getting to and from ... presumably would need to use a chunk of annual leave ... Confused

No. £20K for 50 guests, not including flights, dress, suits, bridesmaids' dresses, etc, etc. Can’t remember if it included catering or accommodation.

I don't think that Demara's legal department will be impressed with sulking as a business strategy

If this were a normal share farming/ contract farming arrangement it would contain provision that each party must implement its obligations; that if one party fails to do so the other party can (a) seek to enforce the obligations (b) carry out the other party's obligations and recover the costs of doing so and (c) terminate the contract and seek damages.

But if BL wants to seek damages against the witless trio the there is an expectation that a party who has suffered a loss takes its own steps to mitigate that loss. BL can sit around doing nothing when it becomes clear the witless trio isn't doing its part but that failure will have a bearing on any loss they expect to recover. A simple example if land is leased for 20 years and a tenant can't pay after the first 6 months the landlord should take steps to terminate the lease and re-let. The loss is the unpaid rent and expenses of termination and re-letting until new tenant starts paying. This is not a duty enforceable by anyone, but recognises that if the landlord fails to do anything his recovery of loss will be affected by his own failure to mitigate his situation.

At the moment it is very easy for the parties to be put back in the position they were in. BL has contributed nothing other than make the land available. They can get the land back. If the witless trio make clear they cannot/ will not be able to implement the contract if BL fail to mitigate its loss that will be taken into account if they sued for damages.

I suspect that Phoebe, Pip and Rex haven't even had the sense to draw up a formal partnership agreement, given they couldn't be bothered to get a lawyer to check out a major contract for them.

Destination wedding in Bali. If either of my children told us they were planning similar, let alone asked us to cough up a large chunk of the cost, I'd feel I'd failed as a parent. Can't see Kirsty the Ecowarrior taking this quietly either.

Rewilding SL ..... don't care. Hate this SL. I want it to go away and never be mentioned again, preferably taking Phoebe with it. Nobody ever talks about Adam being kidnapped as a baby (I only found about it from one of my Archers books - apparently it was a desperate attempt to boost the ratings in the 60s when most of the audience had deserted TA and watched TV instead) so there's a precedent.

Small question about the rewilding scheme - I don’t know if it’s permissible to bring things like this up, but there’s always a lot of chat on DumTeeDum about how the scheme makes a profit, and I know they were asked about it during the interviews. When was the criterion of making money (beyond running costs after the initial cash injection) actually mentioned? Surely the whole point of a charitable trust is that it’s not for the purpose of making profit? I’ve just got very confused about the whole thing.
