How long has Jazzer worked for Tom (as in been employed)? And does he have a contract? No redundancy payment within a small number of years I think 2 but stand to be corrected. Also if no contract then Jazzer never employed hence has less of a case but custom and practice will impact here too
That is nonsense. Unless someone is a genuine self- employed independent contractor (and it has to be genuine , employment tribunals take a dim view of patently fake " self- employed contractor claims by employers) if you pay someone to turn up every day and carry out work under your direction that person is an employee whether or not there is anything in writing. The terms of the employment contract will be as applied by employment legislation.
Of course Jazzer is an employee , regardless of whether there is anything in writing.
There are strict protocols for dealing with redundancy , including proper consultation, none of which Tom followed.
