Thought I'd start a new thread as previous one had hit 1000 posts and wouldn't let me reply!

@LookingOptimistic why do solicitors have to be so difficult at times? Hope it gets resolved for you soon.

The indemnity policy came through this afternoon, so we're hoping we might be exchanging sometime next week...unless something else crops up!

It wouldn't be unusual for a solicitor to have around 150 files on the go at any one time, and they simply haven't got the time to be chasing the other side as often as might be ideal.

In situations like this it's usually the estate agent who is able to give your buyers solicitor a nudge and chivvy them along.

Prepare yourself for another batch of enquiries when they've been through the management pack.

Get your EA to start earning their money!

You're paying them, so you certainly shouldn't feel that you're a nuisance.

Leave the solicitors to do the real legal work, and get the EA to chase people along and make sure messages are communicated effectively, so that all parties are aware of target dates etc.

Hi all, can I join?

We accepted offer on our flat end of Nov to first time buyers who aren't in a rush as we then couldn't find a house... we found one mid Jan and have had mortgage accepted and they're valuing it tomorrow.

A few qs:

  • WHY IS EVERYTHING SO EXPENSIVE? Management pack was £420, Deed of Covenant £198.
-My partner doesn't want a survey, I do. He says that they're useless - can anyone advise? Realistically, unless it's falling down or there's knotweed present, we would still buy?

Stamp duty is killing us.
We want to be complete by mid april

@tenapenny2018 mine sounds a bit different to yours. I am the seller who currently 'owns' the garage. It's in my drive and I have the key, the house was sold to me with the garage. However, it turns out that 'nobody' owned my garage, it wasn't on the lease, included in the deeds or on the land registry plan. So I needed to start the process to be the official owner, of my own garage! To be honest, it's been a complete and utter nightmare and has been going on since the end of September 2018 (we accepted our offer in August) it's taken an eternity as we needed to get a new lease written up to include the garage and has cost £3900. We finally have the lease now including the garage and our buyers solicitor still want even more amendments, so here we are, 27 weeks on, we've had 2 houses fall through due to the delay but I think that we're really almost there.

It's been an utter nightmare!!!

Yep @alotofquestionsallthetime it's all ridiculously expensive, just for bits of paper! I think it's like a wedding, tie something to a house move and they know you've got to have it, so they charge a fortune - for nothing!!

In a nutshell @tenapenny2018 my advice would be do not move into that property until the lease is straight or you could be in for a world of problems down the line! As the seller I've had to pay everything as until it's sorted I can't really sell to everyone

Hello all, update from me.

I paid for my searches on Friday but it hasn't cleared my account yet so hopefully they'll apply for the searches tomorrow instead... There are some very minor queries from the survey so I thought that unless anything came up in the searches then we'd be ready to exchange in 2-3 weeks.

However.

I found out today that the sellers are buying a leasehold property, and the management pack hasn't come through yet. The estate agents will chase next week, but I'm a bit peeved that no one thought to update me on the sellers purchase. My vendors also want to move before Brexit happens, so at least we've got that going for us. Fingers crossed the pack turns up this week and there aren't too many queries from it!

@1sttimedad I feel your pain... :( I hope there aren't too many more delays for you

@alotofquestionsallthetime - welcome! I'm afraid it's going to be cost after cost from now on. However I'm with your partner for n getting a survey. It's another cost and will probably show up nothing but you should get one online case there is a hidden nasty that is going to cost ££££ - you might need to walk away or renegotiate on price. Hopefully there will be nothing like that but do you really want that risk?

Just wondering if anyone has used Sainsbury's bank for a mortgage? Our buyers buyer is using them and they seem a bit crap. Very slow in progress - although it's possible that's the individuals involved and not Sainsbury's! DH is a bit of a financial whizz so got our mortgage sorted very quickly - i can't understand why these people are so apparently inept 😬

TokyoSushi Thanks for more detailed explanation. It does look like your case is more complicated than mine.

I am at week 12, though obviously everything stopped for 2 weeks over Xmas and new year.

In my case, at least the title and plan do state that the garage lease comes with the house. I guess I just have to wait for my solicitor's advice, who is on leave until Thursday!

I've had a day or two halves today

Negatives....doesnt look like I'll be moving Friday which was the origional plan...
Noone seems to be able to locate the sign off certificate for boiler installation...boiler 5 years old and recently maintained. If I'm honest I'm shocked the boiler has caused me this much grief. Its perfect and put in with my house (which btw is also perfectly built no issues at all just too small for me now.. ) so I gave up today and asked for an indemnity insurance to be logged.

Positives are that now with the indemnity insurance in place all enquiries are dealt with so we are making progress

This whole thing is a nightmare and sometimes I think I may be crazy because my house is pretty perfect. 5 years old decorated exactly to my style....the kitchen is gorgeous...mortgage tiny...and I'm going through all this GRIEF to move to a grubby (but much bigger) house with disgusting carpets and tiles and a manky kitchen and a GAS LEAK last time I visited and double the mortgage

Why am I putting myself through this! Half of me feels like if my buyers pull out now I'll just think aw fuck it and go a holiday I've lost the plot I think Confused

@Milly90 sounds like you've had a day of it. At least all enquiries are dealt with now which is good.

We are similar to you in the fact we had a really small mortgage and it will go up by about 4 times...very scary.

Try and think back to what you loved about the house, and you'll soon have it looking like your old one.

Will you be in by next week?

We were supposed to be exchanging the first week of January (we are the buyers), delayed due to solicitors disagreeing on indemnity insurance; sellers are happy to pay but they are disagreeing about what covers the issue sufficiently. I am due to give birth next week and we have nowhere to live which is interesting- kept getting told good to go x date and then no movement. Sellers are ready to vacate at any time, so hoping for a miracle and possibly paying the extra to exchange and complete on the same day, eurgh.

Oh God @roxyxoxo that sounds awful!
I did have to take matters into my own hands to move things along quite a bit and I was the one who suggested indemnity for the boiler and suggested this to the buyer myself and then told the solicitor to stop faffing about with the builder company and move onto indemnity.

Tbh I've lost my mojo now. Just said to dh I've reached the "fuck it all" stage.
@alifelessordinary I am now hoping for Monday. Believe it when I see it 😂

Thank you both :) the annoying thing is is that the sellers purchased a policy recommended by our solicitor without delay to get things moving, but ours then said the policy wasn’t suitable Confused we haven’t laid our cards out, but if the new one ever materialises and turns out to be expensive we are happy to pay half if the sellers are hesitant (although they have been great so far). We have been looking into rentals to bridge the gap for the past 2 months in case but no luck. Just hoping LO stays put and everyone keeps pushing for progress.

@Roxyxoxo - that's stress you absolutely don't need at this stage. Deep breaths and stay calm. I know it's not how you imagined it would be but in a few weeks you'll be settled and have a gorgeous baby.

Sorry to hear about all the stresses Roxy and Milly. The whole process is a nightmare.

We've had our searches back and raised some enquiries as, although it is 'green' for the flooding risk, the groundwater flooding risk is 'moderate'. Also there has been chalk mining in the area in the past so we'll have to get a chalk mining report. Surveyor going in tomorrow so have forwarded details of this to them to pay particular attention to. I'll have to phone insurers too to get some idea of buildings cover for those two things. If they exclude subsidence cover, then we can't proceed Sad. Just hoping these are standard things that searches throw up. It's a built up area so surely everyone has insurance?

We're exchanging on the 1st of March. I cannot wait, the buyer emailed us saying he wants to purchase our apartment. Finally, since we've been at it ever since Feb of 2018 when we advertised our flat on the market.

We're at week 17 now, last week our solicitor was arguing some points on the lease from the Developer and we've not heard anything else since. Our buyer kicked off by ringing our sol directly and told her we should just move out.

Spoken to sales lady she said nothing has changed with dates it's all still going forward but this isn't in stone yet. The house is due to be finished this friday, sales lady said we should be in first two weeks of march. My worry is they will say okay here is the date you can move in. But then the solicitor queries are still outstanding - our buyer has insisted we complete by March 22nd. WIBU to say to our sol - If we get a call next week saying we can have the house by 8th March how far off is she with her work on this? I'm so frustrated with not knowing how far off anything is, I have a full house to pack with no definite date and that's not giving me any motivation to actually do the packing.

I know what you mean @hartof I feel as though we need to exchange before starting to pack but it doesn’t feel feasible if there is only a week gap between exchange and completion.

That’s really frustrating @Milly90 Hopefully everything is lined up now.

@TokyoSushi Are you able to get any costs back from the solicitors who did your conveyancing and missed the garage lease problem when you bought?

Things are progressing ok here. House sellers want to complete on the 22nd March which suits us. I hope our buyer is happy with that and nothing pops up to cause any problems. This thread is a stark warning that things seldom go smoothly.

Exactly @ALadyofLetters ! We only have weekends to pack, DH is currently doing a NEBOSH course so that's taking up all his time and I am more or less doing it on my own. A house we have lived in for 14 years, I thought we'd done all our clearing up and just have to pick but everytime I start to pack I find more things to throw away!

I'm just going to get on with it and leave the bare minimum out and cross everything it all works out.
