Thought I'd start a new thread as previous one had hit 1000 posts and wouldn't let me reply!

@LookingOptimistic why do solicitors have to be so difficult at times? Hope it gets resolved for you soon.

The indemnity policy came through this afternoon, so we're hoping we might be exchanging sometime next week...unless something else crops up!

@ABingThing - you'll need to keep in touch via the EA. Keep letting them know what you're doing to get another sale. How many viewings, price drop etc. You could drop them a hand written note given you know where they live. I always work on the basis that it's harder to treat people badly / let them down if you have some connection to them. There are (as @WBWIFE has found) plenty of CFs out there so maybe my 'treat others as you'd like to be treated yourself' strategy is flawed.

That said I think it's reasonable of a vendor to re-market their house if the chain breaks. We certainly would.

Please can I join?

We are selling out little 2 bed (me dh, dd1 (11) dd2 (7) ds 1 (1) and moving to a 4 bed

We went on the market on 4th dec and accepted full asking on 17th dec,

All was going ahead well until last week- supposed to move in 28th, phone call on 27th saying its been cancelled. Theres been a boundary dispute at the bottom of the chain.

So we were told our buyer was a first time buyer and the house were buying is vacant so no real chain.... turns out were in a big chain of god knows how many people

We now have no date and are surrounded by boxes and paper plates.

@Frogqueen13 - have you exchanged? If you have and it's been cancelled you would be due for compensation. I suspect you haven't from the sounds of it.

As you sold quite quickly hopefully you can find another buyer again and maybe still get the house you want. It sounds like your house is one for an FTB - there will be another one out there.

Yeah contracts signed in feb....

I have submitted receipts for what we lost, hotel room, van deposit etc. Waiting to hear about compensation.

@Frogqueen13 - that's awful. Is it all cancelled? Doesn't that mean someone will lose their deposit? A friend of mine suffered delayed completion (an American couple hadn't taken into account time difference for funds to be transferred) but did complete a couple of days late. Their buyer had to pay significant compensation.

Completed and moved in yesterday! Too much unpack to do. Confused

We’ve finished pack the old house around 10 ish yesterday and we were sitting in a cafe to wait the call from our solicitor. We were so anxious and worried something would go wrong. She called around 10:30 and confirmed the transaction was completed. Phew! The whole process was just too stressful! Not again in a very long time for sure!Grin

Can I join? Just found out I’m pregnant with DC2. We only live in a tiny studio apartment, so will be trying to move to a 2 bed in the next few months. Thankfully we don’t have to sell, as our house is owned by my DGM and DGD, but am terrified about the prospect of moving.

Regarding gas certs and electric certs, who pays for it?

I've read online that it's the buyers if the house, not the sellers and sellers aren't legally obliged to.

What's everyone done?

We are going to pay for the house we are buying tinbe done so surely we arent liable for the house we are selling too?

@WBWIFE we've has a gas safety certificate and our chimney swept at our expense. We had them done before we put the house on the market as we assumed it would come up at some stage.
We had an Electric cerificate one from having the consumer unit changed a couple of years ago.

The chain is still there its just one of the solicitors further down somehow got his wires crossed and informed the other that contract were signed and there was no issues.

Agreed the 28th them boom....

Our little house looks so naked. All empty woth gro blinds up instead of curtains

The question about gas and electric test certs comes up all the time.

A seller is not legally bound to prove the certificates (but to let properties are different, but for the purposes of this question, I'll stick with plain residential).

A seller might agree to it or not. There's no duty. If they refuse the buyer can liaise with the estate agent and organise this themselves.

Remember buyer beware. You have little or no come back if you find out the electrics etc are screwed after exchange/completion (unless in rare circumstances you can prove fraud/misrep).

So just because you said you'd do it on your sale, doesn't mean that your sellers should agree on your purchase.

@Frogqueen13 it is incredibly rare for completion not to take place as planned after exchange.

You will be able to claim from the next in line on the chain for your losses and if they aren't to blame, they will pass it on down the chain until it reaches the breaching party. There's also a small amount of interest but that's 4% of the purchase price so not much.

If you haven't exchanged, you will only recover any loss due to the good grace of the 'defaulting' party - even though technically there is no default because there's no exchange.

I thought it was down to buyer as surely seller could just bodge something.

The first house I thought hey offered thei in date gas certificate and I got in their and the boiler was condemned! So we have always since had ours done ourselves on our purchase

If their certificate is from a qualified gas engineer, i.e. the only ones that are valid, wouldn't you have had recourse against that engineer for falsely declaring the boiler safe.

It might be a local thing but round here, Wilts area, the norm seems to be for the seller to present a valid certificate. We get our boiler serviced and checked annually, so always have a current certificate to hand.

@seventy5days we are in Bristol I dont mind providing gas safe cert if we have to but i ve had quotes of £220 for electric one!

I'm already replacing 3 handles on the windows as they are stiff and they've also ended up getting my freestanding smeg range cooker for free, estate agent is taking £200 off our fees!! (How kind of him - not!)

So I'm reluctant to have to pay 220 plus 80 for electric and gas cert for my buyers and then the same again for my new house.

The window handles are £230 which were replacing and I could have sold my oven easily for around £450 which they have got for free! Then it will be £600 for my gas and electric certs for new house and also for our buyers?

Dont feel like I should be spending all that for in the interest of our buyers.

They also arent providing gas and electricity trim certs for their buyers. They are just greedy I think!

We rang our solicitors when our boiler was condemned and she said theres not a lot you can do unless you want to take the gas engineer to court when the court fees would probably end up just as much as a new boiler was for me!

@jouley they won't pull out. I think FTB are quite impatient. They also don't really know how the process works but are usually fine if things are explained.

@thesunshinesupernova I find it hard to believe all three viewers haven't provided feedback. We've had feedback from every single viewing. One took a while but still gave it. We had steady viewings. We've been on for 5 weeks and have had two offers now. We are in the midlands.

@WBWIFE Jeez some people, what a joke. I'm glad you've not given in. Great that you get some money back too. Hopefully it all progresses fast for you now.

We feel bad as we are on as no chain. We were intending to buy a new build but they've sold. One buyer is ok with that, I'm not sure about the other as they won't make their final offer until Tuesday. Anyway we are now struggling to find something we like. We don't want to move again so it needs to be right. We found one which is gorgeous but a bit more than we want to spend. Bedroom 4 is teeny and so is the bathroom. Bedroom 2 and 3 aren't very big either. The kitchen has lots of marks on the unit paintwork as it's quite old. Garden is very big. We spoke to the vendor last week and although she agreed that the bedrooms are very small and that she feels it needs an extension and the bathroom sorting, she didn't seem very likely to budge on price. Can I pm anyone with help on an offer and also to look at a few others on my list for opinions pretty please.
