Boundary dispute

Bought a bottom flat which is leasehold and it had been empty two years. The upstairs flat (only two flats) are trying to use 3 ft of the concrete yard. They have while it was empty installed an outside tap and a washing line and keep their bins there. I moved in at the beginning of the year and asked them not to use my yard. I want to put a fence up at the edge of my land but they refuse and say it needs to be 3ft in so they can use the tap and the washing line. The plan that is registered with the land registry shows the yard is my flats. There is also shared land around the flat and they are using it for their car and there’s no room for my car and if I leave my bin on the shared land they move them to the yard. I put my car on the shared drive when they were out once and they screamed at me banging the door until I moved it. My lease shows it to be shared land clearly and the yard mine alone. They want to use the first 3 ft of my yard. Can I put a fence up to stop this along the boundary or do I have to let them use my yard? Freeholder not interested and won’t get involved. I just don’t want them in my yard and I want to be secure. Am I wrong?

I no longer let them get in my headspace. They are irrelevant to me.

You are super duper clever and I applaud your dignity in standing up to these insufferable twats!
I hope your solicitor has sent a strongly worded letter to the council asking why you were not advised of the neighbour disputes and problems before you purchased this flat.

The best bit was they parked over the driveway gates to block me in, all smug that I would have to ask them to move. Errr not going to bother me lol!

Don’t think they thought i would do that. But I couldn’t use the space anyway as they always are in it. And now I can get my bin out and actually get past. Cost me a few hundred pounds but who cares! Had to take a day off too as the car is always there when I go to work and back by the time I get back. They only work a few hours in the middle of the day. I had to climb out of my front window last week as I couldn’t get past. That was the last straw so the plan was hatched.

Fab result! But do continue to pursue the council (via solicitor) for not disclosing the dispute when you purchased. Hopefully you should receive ££,£££ in compensation as you will need to declare this dispute and your ongoing problems if you come to sell, devaluing your house by that amount.

I think you've been very brave OP. How horrible this has been for you. Does your solicitor think you have a strong case? It sounds to me like you do. Is there any chance the solicitor screwed up the first time around though?

It certainly does sound like they have finally met their match. Any news on the FOI request? If they have been problematic tenants and the council didn't disclose this then they have been very naughty. Gives you a bit more leverage

I will when my solicitor has something. Today I had a day off randomly, I’m usually at work, but the office air conditioning broke so I was at home catching up. There was a knock at the door. It was the local council abandoned car man. He said he had a report a car was abandoned on the drive. I told him it was mine and it was on my drive as in my lease, registered to me at my address etc. He was ok well I just had to check it was registered to someone at this address. I said it is and It’s my drive. He said well that makes my job easier so I don’t have to contact DVLA. Cheeky fuckers! But the council can’t remove cars off private land just because upstairs doesn’t like it! They will just have to put up with it.

They don’t bother me at all. I no longer give them headspace. Though I did have to smile at trying to get the council to remove my car! So funny. How did they ever think that would work? Sounds like they are desperate.

Random, I couldn’t give a monkeys if they burnt it out or not. It’s still not moving! Cost so little. And I have a car I use already. If they do anything to it then it will just sit there looking bad and anyway the cctv covers it. And it’s very close to their front door so the risk setting their own home alight if they did. Either way I has no purpose by to keep my access clear. Thanks for all the support.
