Bought a bottom flat which is leasehold and it had been empty two years. The upstairs flat (only two flats) are trying to use 3 ft of the concrete yard. They have while it was empty installed an outside tap and a washing line and keep their bins there. I moved in at the beginning of the year and asked them not to use my yard. I want to put a fence up at the edge of my land but they refuse and say it needs to be 3ft in so they can use the tap and the washing line. The plan that is registered with the land registry shows the yard is my flats. There is also shared land around the flat and they are using it for their car and there’s no room for my car and if I leave my bin on the shared land they move them to the yard. I put my car on the shared drive when they were out once and they screamed at me banging the door until I moved it. My lease shows it to be shared land clearly and the yard mine alone. They want to use the first 3 ft of my yard. Can I put a fence up to stop this along the boundary or do I have to let them use my yard? Freeholder not interested and won’t get involved. I just don’t want them in my yard and I want to be secure. Am I wrong?

Ah yes, I hadn’t RTFT before so I’d missed the violence and the threat to kill you. So presumably the police have a record of your case? I think you have to record and report every single thing. This isn’t just asbo neighbours is it, it’s more serious than that.

Wow I had wondered how it was going, didn't think they would get so petty and childish as to block in your bins and stop you getting out of the gate. I'd message the PCSO each time they block you in and stop you getting the bins out.

You need to resolve this as soon as possible as the longer this continues, the worse it can be for you.
As someone said, send them a copy of the land registry plans with a cease and desist letter from your solicitor.
Also send the same letter to the landlord (with the attachments), letting him/her know that if he does not resolve this issue quickly, you have no option but to take legal action, which will result in you suing both of them for your costs.
Make sure to instruct your solicitor to send both letters certified mail with signature required.
Make you receive copy of the signed mail delivery from the solicitor for our records
In the meantime, if you can afford it have some cameras installed for your protection.

Forgot to add, get yourself a decent camera with a date stamp, and start taking photos of all the dog crap etc for your case.

Can't remember do they own it or rent from the council ? If they rent it I'd be phoning them, if they own I'd be phoning the police, what if there was a fire ? You needed an ambulance etc ?

Actually as the council owns the lease I'd be ringing them as well

Re the double gates: can you lift them up off the hinges? Failing that a crow bar on the lock.
And yes, report and document every threat and incident, they are trying very hard to bully you.

I spent last night writing it all down and included pictures of all the blocking in etc. Then I emailed it to the freeholder. They also own as leaseholders same as me. Yes they frequently block me from my own flat and refuse to answer their door. No ambulance could get past etc.
It’s bullying.

The freeholder sent us both the land registry plans and a letter explaining them. It hasn’t worked.

This is crazy. Sorry you are having to deal with it. If they hounded out the last owners was this disloded to you? If not you may want to revert to the solicitor who handled your sale and check your legal position. Am wondering if you can obtain damages.

The last people were all Council tenants. The council sold it to me.

When you get hold of your solicitor I'd make sure she knows the last few tenants where hounded out and the couple did,failed to tell you that.

Poor you, OP. How vile.

You might want to ask the Council why the flat was empty for so long before you bought it. Had other sales fallen through because of the neighbours? Why hadn't the council put tenants in there given the pressure on social housing? I wonder if your nicer neighbours can shed any light on it...

So when I moved in there was various old post with names on and I have located past tenants via the power of fb. They had the same problems almost identical in fact! And they say the council knew.
