Boundary dispute

Bought a bottom flat which is leasehold and it had been empty two years. The upstairs flat (only two flats) are trying to use 3 ft of the concrete yard. They have while it was empty installed an outside tap and a washing line and keep their bins there. I moved in at the beginning of the year and asked them not to use my yard. I want to put a fence up at the edge of my land but they refuse and say it needs to be 3ft in so they can use the tap and the washing line. The plan that is registered with the land registry shows the yard is my flats. There is also shared land around the flat and they are using it for their car and there’s no room for my car and if I leave my bin on the shared land they move them to the yard. I put my car on the shared drive when they were out once and they screamed at me banging the door until I moved it. My lease shows it to be shared land clearly and the yard mine alone. They want to use the first 3 ft of my yard. Can I put a fence up to stop this along the boundary or do I have to let them use my yard? Freeholder not interested and won’t get involved. I just don’t want them in my yard and I want to be secure. Am I wrong?

If they're parked on the pavement and are blocking a dropped curb driveway, they are parking illegally.

Problem is it’s not on the road but the path they park. And I don’t want to move my car out.

The best bit was they parked over the driveway gates to block me in, all smug that I would have to ask them to move. Errr not going to bother me lol!

dont forget its illegal to block someones access to the highway, so you could get them moved when they block you?

Causing Obstruction

Cause unnecessary obstruction by motor vehicle - Contrary to regulation 103 of the Road Vehicles (Construction and Use) Regulations 1986, section 42 of the Road Traffic Act 1988 and Schedule 2 to the Road Traffic Offenders Act 1988

Regulation 103 of the Road Vehicles (Construction and Use) Regulations 1986 creates the offence of unnecessary obstruction.

103. No person in charge of a motor vehicle or trailer shall cause or permit the vehicle to stand on a road so as to cause any unnecessary obstruction.

Removal

Removal and Disposal of Vehicles Regulations 1986 provide for the removal and disposal of broken down, illegally parked or abandoned vehicles. To get your vehicle towed away in some cases which means the owner will have to pay the recovery costs to get the car back.

Do they realise they are being filmed or is this just another example of their monumental thickishness? I’m quite surprised they haven’t tried to damage the cctv if they do realise.

I’ve got cctv of them writing down the car details so it had to be them. Their plan might have worked if I had been at work as usual. It was sheer luck I was home when the council man came.

I’m going to sue for the cost of the damage to the car seeing as I’ve got it on cctv. I bet it’s more than I paid for the car! 😂

I just reported it to the police. I reported the damage online and got a reply last weekend. So I sent them another email adding about the v5 on to it. We will see what happens. I think their previous parking was anti social behaviour too.

Bloody hell blue! Well ducking played on the old car, they must be spitting to be outwitted. I can’t believe the cheeky fuckers registered your car in someone else name, that’s outrageous. Surely you could go to the police with that as that is surely the definition of harrasment???

I got them to remove the lock but putting my own fence up and keeping it locked, therefore they had to take the lock off or no deliveries to their own flat! Out smarted them lol

Writing about the sorn made me realise I could check online that they accepted my sorn and they have so it must be reregistered into my name.
