Hi, after a few days spent lurking I have registered so I can join you all on here (aren't you so glad? 😉). I am in the early stages of selling my shared ownership flat to a ftb and buying my (hopefully) dream home. I had the go ahead that the sale of my flat was ok to go ahead two weeks ago and then after some lengthy negotiation had my offer accepted on the house a week last Thursday. I only just had my memorandum of sale through today because it has taken my vendor this long (1.5 weeks!) to instruct a solicitor. I'm really hoping that she won't take that long over every action or maybe IABU?
Anyway, I am cautiously optimistic about moving before Christmas but from reading through here that seems highly unlikely! My vendor is moving to a rental so at least it is a short chain.

We had one last epic act of fuckwittery from our buyer yesterday - they didn't get to the bank on time to transfer their funds to their solicitor so we could exchange. They went at lunchtime, funds arrived at 6pm, past close of business for all solicitors involved. Angry But hey, the money's there now and we're exchanging first thing!

I'm mildly very panicked about moving on Friday though. Even though we've stripped our place back to bare bones in anticipation of moving, it still looks so full and I just can't envisage how the packers are going to get it all done on Thursday/Friday morning!

Any news on your 40 minute viewers Yoga? Sending sympathy and Flowers to Lazy on no news, Honey on the lost purchase - is it really all over do you think? - and Fialor and FTime on incompetant conveyancers. Good news on your bid Toomuch!

A bit of faff at our end. Our buyers have all their surveys back and wanted to haggle a bit over price due to damp works required and a retention from their lender. We did anticipate this, so have offered something as a goodwill gesture (they did ask nicely,) so I'm hoping this closes the issue out quickly. Still waiting for building control to untangle themselves and release our certificate too, very much Fx this one isn't going to come back and bite us in the arse....

On the purchase front it turns out there's a bit of land at the end of the garden which isn't on the title deeds! There's a large triangle of land showing on the plan as not belonging to any of the houses on the bordering three streets. From google earth, it looks like all the houses surrounding this triangle have probably pinched a bit of the land over time. Hopefully if it's unregistered and there are no rights of access, an indemnity policy should cover us for the purchase, and perhaps a letter confirming multiple years of uncontested use by the current vendor might enable us to go to the Land Registry for adverse possession once we move in. In other news, the special convenants prevent us from building a lunatic asylum, a public house or operating a steam engine Grin.

I found this page last week whilst frantically searching for some kind of normality in this crazy house selling world! I have been clinging to it since then as moment of sheer indulgence to confirm to me I am not going clean off my head with this insanity!

9 weeks since house sale agreed cash sale (when their family home sold) no chain as buyer of family home ex major retiring from military, 8 weeks since full structural survey completed no issues. Delay on buyer side as needed to complete equity release form as elderly father is officialy purchaser. Dates been given start of October for exchange.
Fast forward to week ending 20th of October our sol advises buyers pushing for exchange on 20th hurrah! Grin
Fast forward to last week and a rushed gas certificate completed etc on the 20th as our solicitor didnt advise us it was required and we find out we are in a chain Shock on 27th. But our contract with buyer is ok..we are ready to exchange.
Yesterday we cant exchange as there is an issue further up the chain (minor issue) EA chased all sol's in chain and there is actually no issue! Push for exchange again...
Today we chase and our solicitor tells us no there is an issue further up the chain that is stopping everyone exchanging and they wont chase anything. Back to EA..they chase everyone and then advise us everyone has exchanged apart from us. Confused

EA spoke to buyer sol and they say that they are wanting to iron out an old public right of way and access that was drawn up in the 1930's to a footpath that is no longer used however, they dont envisage this holding the process up....but it is! The issue is a discrepancy between land registry and County Council map/searches/information.

Sharing to try and offer some empathy to others going through this crazy maze of holdups and secrets! As this page has helped restore my belief in people! Good luck to all who have just exchanged..and also to those on the cusp of exchange also...if you need me you will find me in the nearest vat of vodka!Grin

FTB could you change solicitors? During my second to last move (3 only in the chain, I was FTB) my vendor's vendor sacked their conveyancers mid-way through because they were incompetent and had delayed the tiny chain by months.

Fingers crossed for you Usually - Christmas is not totally out of the question.

Frescoed just want to pre-warn you that if you have a fussy lender, they may insist that the adverse possession is applied for by the sellers before an exchange of contracts can take place. If so, then the application to Land Registry can add a couple of months to the conveyancing process....

Oh yikes Tiglet that sounds like something we want to avoid - we’re relocating for my husband’s work, so we have to physically move even if we can’t get the purchase completed. Our lender seems so laid right now they’re practically horizontal but I guess there’s no knowing what might prompt an issue. Have you had experience of this?

Yup Yoga the covenants also made me think there are several wild and unusual things I’d now like to do/build that I’d never considered before!

Frescoed yes, we had exactly the same problem a few years ago, except we were the sellers! Buyer's lender wouldn't lend without us obtaining the adverse possession prior to exchange.

My solicitor came back this morning to say that the seller won't take 243, so we've offered 245, which is what she was holding out for, and asked for a provisional date of entry of 18 Dec. That was at 11.30 this morning and no further response yet! In my head I am already re-decorating but must remain calm.

We've officially exchanged, with completion on Thursday! Confused Less than 48hrs left in our house - I can't quite believe it!!

We've been lucky enough that despite some significant fuckwittery along the way, it's been a pretty quick process for us. For those that like stats:
19th July - For Sale sign goes up
31st July - On Rightmove
29th August - Accepted offer on our house
12th Sept - Offer accepted on purchase
2nd Oct - Had a baby!
31st Oct - Exchanged
2nd Nov - Completion

Welcome to all the suffering newbies - it's a hard slog but you'll get there!!
