So it looks like we are going to loose the second house too. Feel like crying. Lost tbe first on the day of exchange and now with this one, one of the owners is ill so the son is not responding. (they are an elderly coupld so the son is handling tbe sale) i feel like an aweful human beign, if it was my parent i wouldnt respond either. But we are already homless after the first sale and if we move to a rented place we are commiting at least 6 more months withouf a home. Plus all that money on survey etc wasted again. Even the EA has said to start loominv again. What should we do??? Hang on and see what happens or stsrt again and hope thst 3rd time's tbe charm???? Feel so helpless.

Oh Honey, I'm so sorry to hear you're having a nightmare with house 2. When was the last time you heard from the son? I'm sure he'll get back to you soon. You might just have told hold tight if you really love the house. In the meantime, vent away on here. It's the best place for it! Flowers

Please may I join in here? I'm a FTB, in Scotland, so different system, and I rang my solicitor at 9.30 this morning and asked her to make an offer on our behalf for the very first time...and nothing has fecking happened! I don't know whether she's been unable to contact the seller's solicitor, whether the seller's solicitor has been unable to contact her client, or whether said client is just taking some time to mull over the offer. I'm biting my nails and can't focus on one single thing at work.

This house has been on the market since May and suddenly in the week we decided to offer some other buyer has come out of the woodwork and noted interest, which means that the seller might decide to set a closing date and we will have submit sealed bids and just hope ours is higher. It's complicated by the fact that some fly-by-night surveying company has given it a totally ridiculous value that is much higher than anything else in the street has gone for, so we have offered what we think is a reasonable price but the seller may well have her heart set on the original valuation. Although you'd think the fact that it's been on the market for 5 months without a nibble until now would have given her a clue.

...and breathe. That was cathartic!

Quick update, no one has got back in touch with me after my leaflets but I found another house, offered just under asking price (my top budget) and they're holding out for the asking price Sad

Still continuing with my sale but looks more and more inevitable that I'll have to move out without somewhere to go to ... I hope my FTB's appreciate this Grin

I have just had a request for a document (for the umpteenth time!) that I have sent on no less than 3 occasions to my conveyancers. I am about to tear my hair out. Hopefully though we should be able to exchange withing the next three weeks or so. We have only the bottom of the chain outstanding queries now. Fingers firmly crossed.
Vendor has agreed to carry out the urgent works but wants to do it after exchange. I have said no - I am finalising this with them today and then letting the conveyancer know. Hopefully we are able to move this forward so we can exchange in two weeks, and the complete a week after that. I am beginning to be hopeful.

Honey, I am so sorry that you might lose the house. Keeping fx that it works out for the best. If you can, perhaps an offer of "we can wait a while" might be good for your vendors' son to give him some time to sort out care for his parents?

AnnPerkins and Serial - yah! You have increased the exchanger/non-exchanger ratio already. Do you both have completion dates yet?

MrsPussinBoots, I think the best way here is to push your conveyancers as much as you can, to make sure they do not sit on anything at all, as it comes on. And also for you to respond as quickly as you get a query come. That way you reduce/eliminate the 2/3 days of delays at each enquiry stage which tends to add up.

Lazy, have you had any confirmation that you will exchange this week? It must be frustrating to try and exchange and not been able to do it so far. Fx for you.

Fingers cross for you (and welcome) Cheddar. You never know it could just be that the vendor's at work and will want the evening to think/discuss it. don't rule it out yet Smile

Funny you say that Yoga the EA has just called back and said they are now going to re-think about it overnight. I think my offer was fair but really is the highest I can go without leaving myself with sweet FA to move with wipes sweat from brow as even this is tight

I have another option, a house that needs a bit of renovation - and this EA knows that, so I think it may have panicked them a bit into talking to the vendor again Grin

You are a good prospect Sell - you have already sold to a FTB so chain is in place. Slightly under asking is probably excellent in this climate (and approaching Christmas!) fingers crossed they accept!

Fialor GAH at the doc request - and yes me and he did all the numbers over the weekend and we reckon with the sharp market drop recently it would cost us (actually vastly) more to resell than to rent or airbnb especially if short term. we did 3, 6 and 12 month projections and got properly into it. Renting is going to be way cheaper even if our top of the chain fell through again and we ended up renting longer than planned. He also likes the possibility of airbnb and no contracts etc so potentially saving even more.

So yeah he's totally with me on protecting our sale now. I have this thread to thank for that too as the back up from here helped reassure him Flowers

and.... heard for our solicitors and all is going ahead for our sale exchange this week. That one should be straightforward. Now waiting to hear if our vendors are satisfied with the survey on their onward purchase. If they are, then FX that should be straightforward too

every single finger and toe crossed... we are going to go ahead and exchange on our sale and then rent anyway but it would be nice to know their onward purchase is definitely progressing

Hey not up to date on the thread, but just had to say how massively hugely annoyed I am with this whole ridiculous process! Angry

So Saturdays issue has now been resolved and my buyers have got confirmation from their mortgage lenders that the indemnity issue is fine. But it turns out there was an enquiry outstanding somewhere up the chain (that no one thought to fucking mention) and so the file has only been completed today, and now needs to go to 'compliance' to be checked before our vendors/buyers solicitors (same firm for both!) are willing to exchange. And apparently that takes time, so exchange will now be tomorrow at the earliest.

The issue is that we end up not going ahead, then I only have until tomorrow morning at 8:30 AM to cancel my removal company, or I'm liable for the whole payment. Which is £1400!! So I have said that I will need to cancel the removal by the end of the day if we have not exchanged, which means agreeing a new completion date, which means my sellers mortgage offer expiring. To avoid this, I have said that I will accept assurances that my sellers or their solicitors will cover my removal costs should it NOT go ahead. They're apparently not willing to do that, which makes me doubt how likely it is that it will go ahead!

There's just been so much bullshitting, I simply cannot afford to take it on trust that the exchange will go ahead tomorrow as they have said!

Aargh Nessalina that's totally unreasonable? Are you going to cancel the removal company? Is it worth calling them to explain and see if they can give you until 10.00am say to give you just over an extra hour? As most things presumably won't start moving until 9am when people go into the office

Oh Nessa that's really lousy Sad It certainly sounds as though your sellers are not going to be ready to exchange otherwise they would have been happy to offer you the assurance of paying your removal costs. Although doesn't that rather screw up your seller's mortgage? They'll have to go back to the mortgage company and get an extension. I think in your place I'd cancel the removals. That's a lot of money to lose. Fingers crossed for you.

Apologies for not catching up with the full thread, but I confess I have just had a little cry. I've heard zilch from our solicitor all day - despite leaving messages. I just don't understand what the top of the chain is doing and why they think it's acceptable to leave everyone hanging like this. It's been over 3 weeks now.

Eleventh hour reprieve! When I rang to cancel, our lovely removal company have agreed to an extension on the cancellation waiver until the end of the day tomorrow! They are my new favourite people ever!

I've told our solicitors and EAs that the extension is to midday tomorrow so they've fed that back to buyers/sellers solicitors (as I don't want to be panicking all afternoon whilst they prevaricate further! Hmm) so the exchange must be underway by then and I've been assured that it will happen. I'll believe it when I bloody well see it!

So relieved. I've been in knots all afternoon! I didn't want to let everyone down by cancelling, but I didn't want to risk our money when no one else was willing to risk theirs. Such a stupid system!!

So my solicitor rang back and the seller wanted 250k, but was talked out of it by her solicitor, so came back and said 245. We had offered 240, and have now offered 243. Exciting! No response by 5 o’clock (seller works shifts, apparently, so can be difficult to reach during the day). So maybe tomorrow she’ll go for it! Who knows? DH says we should walk away if she doesn’t, but I don’t want to!

Oh Lazy you poor thing. I can't believe your vendors vendor is being so obtuse and unwilling to engage and that your solicitors are being so difficult to get hold of too. Could you doorstep them, or just ring every 30mins until you get to talk to someone? Are you willing to offer an ultimatum to your vendors - along the lines of exchange by X, breaking the chain if necessary, or you will start looking at alternative properties? I'm so sorry you are still in this position 3 weeks on Wine

Technically not in a chain as it's just us and the seller but need to have a massive rant about how useless our solicitor is so here's hoping you'll have me.

Long story as short as possible: It's now been about 14 weeks since our offer. About 4 weeks ago, it transpired our solicitor had been sat on contract packs for about a month and done literally next to nothing with them. All the while, they'd been telling us everything was going 'fine' and progress would all depend on when the seller's solicitor got back to queries - which, by the way, we then found out they hadn't even raised. We only found out because EA called us in a panic to say nothing had been raised - we thought he must be mistaken at first because our solicitor was swearing up and down that timelines all depended on what they came back with.

So needless to say we're not impressed but give them a stern talking to and tell them we want to exchange by the end of the month so please, pretty please, work to that deadline. Wednesday before last, EA emails to say all queries have been answered, can we get on with exchanging now? We call our solicitor on the Friday who tells us that's complete rubbish, they are still waiting for more answers. Then call them on the Monday of last week when, oh, actually, answers have miraculously appeared out of nowhere but there might be some followups and will let me know by the end of the day. End of the day rolls around and answer comes there none.

So on Tuesday, we call the case manager, stress that we need to be exchanging before the end of the month and ask him to find out what's going on. He'll give me a call back first thing on Wednesday morning. He doesn't. Nor does he return DH's two calls on Wednesday afternoon. But what the cowards do do is drop us a PDF of a letter they are sending us in the post essentially saying 'Yeah, no, we still have a ton of queries outstanding but, look, here's some random papers we did get off the seller with no explanation to what they are! Enjoy reading those!! K! Bye!'

By Thursday, we're pretty livid so call our broker to find out what the heck is going on. Broker speaks to our solicitor, since they don't seem to want to speak to us, and finds out that 11 out of their 13 original queries still need fuller answers. Then we call the EA to ask what the heck is going on because didn't you tell us the seller's solicitor has answered all of these - to which he says, they have but he'll get them to send over the answers again. Then get our broker to find out what's going on....to which our solicitor says, 'Oh, yeah, looks like they've answered three more of our queries! Yay!' Either our broker or our EA then convinces them they might want to pick up the phone to the seller's solicitor because clearly something is going very wrong here.

So come Friday and there's hope on the horizon because the two teams of solicitors actually talk to each other that morning. Seller's solicitor sends over answers, our solicitor confirms they have received answers and will review them shortly.

Today rolls around. Give broker a call midday-ish to find out what's going on. Solicitor leading the case is away from her desk but her junior says she's aware there is something she needs to review. Broker asks for a call back. They don't so he chases late afternoon - only to be told they've pretty much not touched the file since midday on Friday but they super pinky promise they'll do it tomorrow for suresies. EA is also now informing us the seller is at the end of their tether, has no faith in our solicitor to get this done and wants to put the house back on the market. We obviously don't want them to but, by this point, I can hardly blame them.

Oh, did I forget to mention that a) just about every review I read for our solicitor is glowing so we're supposedly using the best-of-the-best rather than some fly-by-night cowboy and b) we've done EVERYTHING at our end, as in contracts signed and sent back via guaranteed delivery, deposit and stamp duty sat in the solicitor's account, buildings insurance all paid up etc. so the holdup isn't with us and yet we have to sit here constantly apologising for behaviour going on at our end of the deal.

....We're not exchanging by the end of the month, are we?
