Can anyone give me hope that if no chain involved, it's possible to complete and exchange within 30 days (28 days counting down today)? - our mortgage is certain to be offered within 1 week though. The EA keeps on saying it should be fine, because seller's paperworks are very up to date from previous failed transaction, but I'm still extremely nervous Sad.

fingers and toes crossed for both of us Yoga, when was your sales/offer agreed? Sorry I lost track. Our offer was agreed on Monday later afternoon this week, valuation is yet to be done. I think I will everyday check the status with our solicitor, and seller's solicitor. Just sent an email (sent 6/7 so far today) to the EA, asking for permission to talk to the seller' solicitor directly checking on progress. Is this acceptable?
Our solicitor is good with replying to us, but she isn't good with following up with others (I can understand, we are not her only client I guess, but sometimes I feel like I do Grin with how many times we called her).

Hi everyone, sorry I’ve been missing from the thread I just got so fed up with the whole thing I just trying to forget about it for a couple of weeks. Congrats to those who have exchanged and completed since the last time I checked and sorry to those who have got shitty buyers Sad
My update, we’ve been ready to exchange for 2 days now but last minute issues have thrown a spanner in the works. Ended up having to pay £500 for an indemnity policy yesterday as the development we’re selling on haven’t had their roads adopted by council yet. All a complete nightmare but we figured it’s a small price to pay to get it done. Looked like we’d exchange today at 4pm but money didn’t quite make it to my new build developer at top of chain so we’re going for first thing tomorrow with completion next Thursday, 30th! I’m so bloody relieved now we nearly seem to be there, 6 months after house went on market following the end of my marriage.
I’m hoping I can move straight into my new place next Thursday but awaiting confirmation from the developer, if not I’ll go and stay with a friend for a few days (and have to move twice 🙄)
On the plus side all of my integrated appliances are in now and my flooring is going down. As soon as we’ve exchanged tomorrow I shall order all of my furniture with the hope it can be delivered on completion day. My ex husband has taken a lot of our furniture so I don’t have much to move so will be doing it myself! Wish me luck Smile

OMG Lubey, I will be furious too if I were you. We almost had to commit to 6 months rent (now only 2 months rent) because our vendor hiding from us from the beginning there is a dispute between him and the freeholder. Fucking furious when we found out. Any delays now even only 1 day, I am smelling it as there is something wrong behind the scene. Cannot trust anyone anymore.

Are you able to list straightaway? Its not much comfort but it sounds very much like your vendor was looking for an excuse to walk; good riddance. Hopefully you can relist, if that works for you, and the right buyer will come along.

Stormy, do you know if it is a lending requirement? If it is not, then you should be able to exchange before the land registry item is finalised. The issue would be that your solicitor might not want to draw up any extra paperwork, as the extra paperwork would make it a non standard sale. But I would push for it if it were what I wanted. The solicitor works for me after all; they can advise but the ultimate risk/reward benefit analysis is made by you and the risk taken by you.

lubey hope that they will come to sense to understand your situation and move into rent ffs.
It took me 2 hours to change the details with our landlord, and costs us only £1.5K for the legal fees to change property (our lender doesn't charge for new mortgage fees because the mortgage offer hasn't been expired yet, and they will refund us the valuation costs on the old property once the new sales is completed) vs. committing to 6 months rent whilst waiting for our no-longer seller to sort out his disputing shit.

Stormy I can't remember precisely what the issue with Land Registry was, but my understanding is that if there are absences of right of ways over neighbouring land for example, and without the rights you would be unable to access the property (either by foot or vehicular) which effectively makes it "land locked", this would have to be sorted out before exchange. Don't forget your seller, the seller's solicitor and the EA all want to sell to you as soon as possible. Your solicitor however is looking at the legal documents to protect you from purchasing a defective title. I know you want it sorted now but if you don't get it right, this will haunt you when you come to sell again in the future.

Hopefully it's actually nothing to do with rights of way over private/council land and is something much more minor!

Fialor, no I'm not ok I'm gutted. Our vendor hasn't made any decisions aout putting it back on the market yet. We have relisted and have two viewings on Sat. Our old old buyer is still interested but doesn't have a buyer so can't proceed. I'm sick and tired of this. The kids are all acting up as they are so dissapointed, my wife is feeling low and angry and I'm now poorly.

Just want to go away on holiday somewhere nice. No money or time though.

Lubey that's just insane, where do these people come from? Fx for a positive resolution today, I hope they see sense.

Well, we're down the the wire a bit today. Vendor's sol sent back responses to our sol - unfortunately, that included not doing the statutory declaration for the land which our sol requested in October (!) but offering something else which our sol thinks won't satisfy the lender. So, either they get it sorted today - and we exchange tomorrow or Monday - or we have to move our completion date. It's not the end of the world if we do have to shunt it, but we're relocating quite far and juggling work and childcare etc - we picked a date with some room to spare and communicated it to both buyer and vendor right at the beginning (in September), so it was an 'agreed' date between us and our buyers, and us and our vendors from the point of agreeing offers. Our solicitor is a bit cross because she doesn't think there's any reason it couldn't have been sorted by now, just the vendor's solicitor has been extremely slow through the whole process. So, I guess I'm spending today being exasperated and ringing round people. Grrr....

Zoe ours has been agreed about a week. really you are in our buyers position rather than ours. But it's sort of the same because effectively it's just our purchaser having to get himself sorted as we are ready. They've already had their mortgage valuation and 2 out of 3 searches are back. We have one month and I don't see why it can't happen. I guess the three things for you are - mortgage approval, survey and searches but if they can be done within a week-10 days it should possible. Yes, just keep pressing.

This is sort of what happened to us - purchaser pulled out over some trivial non-reason then popped up several weeks later (knowing we are not desperate to sell) offering £50k less. Tossers. I've phoned our home insurer company today to tell them we're moving expecting them to tell us that they won't be able to insure the new place (which is G2 listed) but they will - result! And not too hideously expensive either. So now we just need an exchange date and I can sort that out.

Conversely I've phoned for some removal quotes and I may need an additional mortgage to cover the removals Shock although that particular company I remember being very expensive last time we got quotes too. But we want packing and we're moving to an old listed house so I want lots of insurance and people who know what they're doing and aren't going to damage anything! The other two I've rung won't even give a ball park until they've seen the place so they're coming next week. I really hope they are a bit cheaper or Christmas is cancelled Wink

We’ve exchanged!! So many tears of happiness this morning, it’s all finally nearly over. Lots of heartbreak and awfulness for the last 6 months but next Thursday I get to start my new life as a single lady in my lovely new apartment. I couldn’t be happier or more excited Smile
