CAN I SUE CMS?

Is it possible at all to sue CMS for being totally useless at recovering all 23k of unpaid child maintenance payments over past 3 years from my deadbeat ex husband ?

WHY IS IT STILL POSSIBLE FOR PEOPLE TO GET AWAY WITH THIS ???? (Sigh)

I have no idea if it is possible to sue but the CMS suddenly managed to take action against my EX when I complained to them via my MP.

I don't know either. Have you taken it to court? Contact DWP there is a form on the Gov website. CMS need to do a mandatory reconsideration first though.

Yes it’s been to court. They explicitly say “you’re owed 23k” but the judge ordered the weekly payment only not, the last payments. (Not that any of it is being paid)

the ex isn’t respecting the judges order to make payments.

CMS Doesn’t seem to be useful all and last time said “we are concerned about going after him for payments for fear of what he might do to you” 🙄🙄🙄

You surely need to contact the courts for advice. CMS don't have the powers nor the will to enforce anything.

CMS do have plenty of powers like seizing assets, taking away driving licenses and passports and arresting wages, they just don't use them.

Has the ex got to pay the money directly to you or to CMS?

I think the person @SquirrellyTheSquirrel Didn’t understand the case.

they have taken the case, to go after this man for child support. He owes me and they are not getting me anything. They are the body in charge of this in the UK. They aren’t doing me any favours, it’s my right I’m looking for here. And yes I can sue them as I’ve just got some answers. You sound bitter.

people , ( as I’m not sure there’s men here) I am so so exhausted. I’m very short of selling my organs in the black market to provide for my kids.
This country is a joke. I am literally going back to Uni this September to join a law degree, so I can get some shit done in the next 10-20 years. ITS UNNACEPTABLE EHAT WOMEN GO THROUGH IN THE UK.

@Flowersun6 so, CMS applies to court to get assets frozen, to seize passports, all these things. They have lawyers who do these on their behalf. Because of such power is why I was interested to find out about suing them. They are a body which have guidelines to follow.

After ten years of dodged payments, CMS took out and were granted two liability orders in court. They haven't been able to enforce them yet as he's apparently back on benefits 🙄
