That's horrific!! no wonder you were reluctant to confront them.. you made the right choice!

sparklymieow · 17/08/2005 16:38

I am sooooo happy!!!! We can relax a bit now, still have to watch out for the other household but they have no back-up now so hopefully they will leave us alone!!

Hulababy · 17/08/2005 17:09

Great news for you

Not sure on sentences for GBH w/i but I do have a few of my inmates inside on some lengthy sentences with it. I'll see if I can find some example sentence lengths tomorrow.

suedonim · 17/08/2005 17:10

Fantastic news!!!!! Have a wonderfully peaceful and relaxed time from now on, Sparklymieow &family!

kid · 17/08/2005 17:13

Someone I know is in custody awaiting sentencing. He was charged with 2 cases of GBH (one with a weapon which he had on show but didn't actually use). He has been told to expect anything up to 5 years.

HuggyBear · 17/08/2005 17:14

Great news

SaintGeorge · 17/08/2005 17:18

Brilliant verdict

I remember when the Woodgate/Bowyer (Leeds Utd) case was in court, one of the guys was done for gbh with intent and affray. He got six years.

Hulababy · 17/08/2005 17:23

Found this:

If you were to cause actual injury to an individual, you could be charged with either grievous bodily harm (GBH) or assault occasioning actual bodily harm (ABH): Offences Against the Person Act 1861. If the injury was very serious then the charge would be GBH.

The maximum penalty for GBH with intent (triable only in the Crown Court) is life imprisonment, for GBH without intent (triable either way) it is five years imprisonment .

. Affray (section 3) This offence can be dealt with either in the magistrates or in the Crown Court, known as 'triable either way' and is punishable in the Crown Court with a maximum of three years imprisonment or an unlimited fine or both and in the magistrates court with a maximum of six months imprisonment or a fine of £5,000 or both.

sparklymieow · 17/08/2005 17:53

OMG!! LIFE!! Plus 3 years!! I knows that the max. sentance but OMG!!!

What great news! You must be so relieved, especially as they have been remanded in custody in the interim.

Now you can enjoy planning your new home even more.

sparklymieow · 17/08/2005 17:55

Does 'GBH with intent' mean intent to kill??? and what does affray mean??

Hulababy · 17/08/2005 17:55

I am trying hard to think of the type of sentences my inmates have - I will have a look tomorrow and see what the typical ones seem to be, and if there is much difference between the YO and the adult sentences.

Hulababy · 17/08/2005 17:56

sparkly - means with intent to cause GBH.

MrsGordonRamsay · 17/08/2005 17:57

thats great news,I'm so pleased to hear it,will make the move alot easier won't it?

Hulababy · 17/08/2005 18:23

The youngest will go to a YO instituate. Prison is for when they turn 21yo (and 10m I think). A YOI can be either a separate place, or part of a HMP. The one I work in is 50/50 YO/HMP.

sparklymieow · 17/08/2005 18:24

The reporter said to me that he found them very intimidating and like 'a pack of wolves' he also said that the youngest one seemed to have been lead astray by his brothers (which is what we said) and might get a lighter sentance as its his first offence. I said to him that the oldest two have only been out of prison for 2 years, and told him what the oldest one was done for last time (armed robbery) and he said 'it was armed robbery??' I said 'yes, search your achieves and you will find it.' He said he would hehe!! They must be doing a piece on them to either get rid of them out of the town or push for ASBOs to be slapped on them as soon as they are released.
